<br />Resolution No. 2004-163 <br />NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to waiver the 60-day <br />advance notice provisions of the Lease between the City and Horizon Activities Center relating <br />to termination of the Lease of the real property located at 26272 Butternut Ridge Road, and to <br />execute a Cancellation and Termination of Lease Agreement with the Board of Trustees of <br />Horizon Activities Center for the purpose of immediately terminating the Lease relating to the <br />said real property formerly used by Horizon to operate an early intervention center for disat>led <br />children. Said Cancellation and Termination of Lease Agreement shall be in the form and <br />substance of the attached Cancellation and Termination of Lease Agreement (Real Property at <br />26272 Butternut Ridge Road) between the City of North Olmsted and the Board of Trustees of <br />Horizon Activities Center, marked as Exhibit A and attached hereto, with only such changes to <br />be hereinafter made as are not substantially adverse to the City and which are approved by the <br />Director of Law. The character of any such changes as not being substantially adverse to the <br />City shall be evidenced conclusively by the execution of the Lease Agreement by the Mayor and <br />its approval by the Director of Law. <br />SECTION 2: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />reason that it is necessary that this Resolution go into effect immediately because the roof of the <br />building on the property is in very bad condition and must be repaired prior to the onset of the <br />fast approaching inclement weather season, and the termination of lease must be in effect on or <br />before the date of such repairs by the City, and further provided it receives the affirmative vote <br />of two-thirds of all members of Council, it shall take effect and be in farce immediately upon its <br />passage and approval by the Mayor. <br />_?- <br />PASSED: '10 ?
