CANCELLATION AND TERMINATION OF LEASE AGREEMENT <br />(Real Property at 26272 Butternut Ridge Road) <br />BETWEEN THE CITY OF NORTH OLMSTED AND <br />THE BOARD OF TRUSTEES OF <br />HORIZON ACTIVITIES CENTER <br />This CANCELLATION AND TE INATION OF LEASE AGREEMENT is executed <br />this day of ??`?'?t C't°r , 2004 by and between the CITY OF NORTH <br />OLMSTED, an Ohio Municipal corporation, located at 5200 Dover Center Road, North Olmsted, <br />Ohio 44070, as Lessor, (hereinafter called the "City") and the BOARD OF TRUSTEES OF <br />HORIZON ACTNITIES CENTER, located at 23755 Lorain Road, North Olmsted, Ohio 44070, <br />as Lessee (hereinafter called "Horizon") <br />WITNESSETH: <br />WHEREAS, on or about August 30, 1989, the City and Horizon, pursuant to North <br />Olmsted Resolution No. 89-64, executed a Lease Agreement for the lease by the City to Horizon <br />of real property located at 26272 Butternut Ridge Road, North Olmsted, Ohio [Permanent Parcel <br />Nos. 235-6-9, 235-6-10, and 235-6-11](hereinafter called "the Property"), for a term of fii'teen <br />(15) years, to be operated as a preschool and park for disabled children and senior citizens; aiid <br />WHEREAS, Horizon since 1989, and more recently its sub-lessee or assignee Special <br />Children First of Ohio, Inc., have operated an early intervention center for disabled children on <br />the Property; and <br />3
