<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2004 -162 <br />BY: Mayor Musial and the Entire City Council <br />AN ORDINANCE AMENDING SECTION 111.01 OF THE <br />ADMINISTRATIVE CODE, ENTITLED "CITY CONTRACTS INVOLVING <br />RECEIPT OF FUNDS," IN ORDER TO EXCEPT CONTRACTS FOR <br />ADVERTISING AT THE RECREATION COMPLEX FROM THE REQUEST <br />FOR PROPOSAL (RFP) REQUIREMENTS OF SAID SECTION 111.01, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the Recreation Commissioner has recommended that this Council authorize <br />the Administration to select a company to sell ads to be placed on the dasherboards and on the <br />walls at the Recreation Complex, without adhering to the RFP process for revenue-generating <br />contracts set forth in Section 111.01 of the Administrative Code; and <br />WHEREAS, this Council finds no tangible benefit will be obtained by the Cit:y, and <br />considerable delay will be occasioned, by requiring the Administration to procure a such contract <br />by following the RFP process for revenue generating contracts set forth in said Section 111.01; <br />and <br />WHEREAS, it is accordingly the desire of this Council to amend Section 111.01 of the <br />Administrative Code so as to except contracts for advertising at the Recreation Complex from <br />the RFP process otherwise required for revenue-generating contracts; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUIVCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Section 111A1 of the Administrative Code, entitled "City Contracts <br />Involving Receipt of Funds," which presently reads as follows: <br />"111.01 CITY CONTRACTS INVOLVING RECEIPT OF FUNDS. <br />(a) Every City contract, whereby as a result the City is to receive instead of expend <br />funds, shall be subject to the requirement that: <br />(1) There be on file with the City, specifications with respect to proposals to <br />be received from interested parties which shall include, but not be limited <br />to, the following items of information: <br />A. Commencement date of contract; <br />B. Term of contract; <br />C. Ending date of contract; <br />D. Contract option terms and prerequisites; <br />E. Description of goods or product to be supplied or sold pursuant to <br />the contract; <br />F. Desired quantity of goods or product to be supplied or sold <br />pursuant to the contract; and <br />G. Any other contract term or condition that is material in nature to <br />the contract; and <br />(2) That a notice requesting an offer of such proposals from interested parties <br />shall be advertised in a newspaper of general circulation within Cuyahoga <br />County for two successive weeks prior to a date certain for submittal of <br />such offers of proposal.
