<br />Ordinance No. 2004-150 <br />SECTION 2: That the Mayor be and he hereby is authorized, upon approval of <br />the Board of Control, to enter into an agreement with the examiner selected in the RFP <br />process. Said agreement shall be in a form and substance that is not substantially adverse <br />to the City and which is approved by the Director of Law. The character of any such <br />changes as not being substantially adverse to the City shall be evidenced conclusively by <br />the execution of the ageement by the Mayor and the approval of the ageement by the <br />Director of Law. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency mea.sure <br />immediately necessary for the preservation of the public peace, health, safety and welfare <br />of this City, and for the further reason that this Ordinance is required to be immediately <br />effective to enable the City to expedite the RFP pFior- due to the October 4, 2004 <br />expiration of the cunent contract for back-up plans examiner services; and further <br />provided that it receives the affirmative vote of two-thirds of all members of Council, it <br />shall take effect and be in force immediately upon its passage and approval by the Mayor. <br />PASSED: <br />ATTTEST.• <br />kA <br />arbara L.
