In the event that the City and other bargaining units fail to agree to the estab(ishment of the <br />Empioyee Health Care Committee set forth above, the Empioyer and AFSCME, OHIO COUNCIL 8, <br />LOCAL 2681 shall meet to negotiate new Health Care provisions. Should the City and AFSCME, OHIO <br />COUNCIL 8, LOCAL 2681 not come to mutual agreement, the issue ofi Health care coverage shall be <br />submitted to binding conciliation under the O. R. C. 4117. <br />ARTICLE 26 - JURY OR WITNESS PAY <br />Section 1. An employee called for jury duty shall be granted a leave of absence for the period of jury <br />service and will be compensated at full pay for absences necessarily caused by the jury duty. The <br />employee shall be entitled to retain jury pay received as reimbursement for expenses incurred in <br />perForming jury duty. An employee who is required to be absent from scheduled work to serve as a <br />witness on a City related issue will be paid for time Iost from schedulsd straight time work. An employee <br />who is called as a witness due to his part-time employment in the area of public law enforcement with the <br />Cifiy of North Olmsted shall receive his regular rate of pay from the City. <br />ARTICLE 27 - SAFETY AND HEALTH <br />Secfiion 1. The City and the Union recognize that each party must comply with the applicable <br />state and federal laws with respect to safety and health. The City shall continue to make reasonable <br />provisions for the safety and health of its employees. <br />A. Required personal protective equipment shall be issued to regular full-time employees and shall <br />be replaced if the equipment is worn out and is returned to the City for replacement. <br />An employee who does not return the equipment will be charged for the replacement cost, except <br />in cases, <br />(1) In which the equipment was destroyed by accidental conditions beyond the employee's <br />control in the work area, or; <br />(2) If the equipment has been stolen and the City has failed to supply the employee with a <br />place to lock up his equipment. <br />B. A safety committee consisting of two (2) representatives from management and two (2) safety <br />representatives appointed by the local union may confer as necessary for the purpose of <br />30 <br />
