ARTICLE 31 - SAVINGS CLAUSE <br />Section 1. The Unian and the Cify recognize that North Olmsted is a home Rule City. Therefore, it is the <br />intent of the City and the Union that this Agreement comply in every respect with appficable legal statutes <br />and charter requirements and if it is determined that any provision of the Agreement <br />is in conflict with law that provision shall be null and void and shall not affect the validity of the remaining <br />Articles af this Agreement. fn the event of an unlawful determination, the City and the Union shall meet <br />within thirly (30) days for the purpose of negofiating a lawful alfiernative provision. Nothing contained in this <br />article shall be construed so as to diminish any right or benefit negotiated by the parties and cantained in <br />this agreement. <br />ARTlCLE 32 - SUB-CONTRACTING <br />Section 1. The City shall meet and confer with the Union prior to sub-cantracting out bargaining unit work, <br />other than emergency work. In the event a subcontract causes a lay-off, the City wi!l make every <br />reasonable attempt to provide an opportunity of employment with the subcontractor for said laid off <br />barga'tning unit employees. <br />Additionally, any sub-contracting of work shafl not result in a layoff, far a period of 1 year, after the <br />date of sub-contract. <br />ARTICLE 33 - LONGEViTY PAY <br />Current <br />Secfion 1. Employees in the bargaining unit, hired before July 20, 1987, having completed five (5) years <br />of full-time continuaus service as employees af said department. or having been transferred from some <br />other department by adrninistrative appointment, shall be paid an additional four percent. (4%) of their <br />base annual salary, thereafter until completion of ten (10) years full-time continuous service; after which <br />such employees shalf receive five (5%) of their base annual salary, thereafter until completion of their <br />33
