properly chargeable as a fair share fee. Employees who have received a Religious <br />Exemption from the State Employment Relations Board are exempt from having dues, <br />assessments and/or a fair share fee deducted from their pay check(s). All fuli-time <br />employees hired after the effective date of this agreement who voluntarily choose not to <br />become dues paying members of the OPBA, sha11 pay the fair share fee, effective sixty <br />(60) days from the empioyees date of hire. The deduction of the fair share fee shall be <br />automatic and does not require a written authorization for a payroll deduction. Payment <br />to the Association of fair share fees shall be made in accordance with the procedure <br />contained within Section 2, above. <br />SECTION 5: In the event that a service fee is to be charged to a duss paying member <br />af the OPBA, the Employer shall deduct such fee in the same manner as dues are <br />deducted as specified in Section 2, above. <br />ARTICLE 5: <br />NON-DiSCRIMINATION <br />SECTION 1: Both the Emp(oyer and the OPBA recognize their respective <br />responsibilities under the Federa( and State Civil Right Laws, Fair Employment <br />Practices Act, and other simifar constitutional and statutory requirements. Therefore, <br />both the Employer and the OPBA hereby reaffirm their commitment, legal and moral, <br />not to discriminate in any manner reiating to empioyment on the basis of race, color, <br />religion, national origin, disability, sex or age. The OPBA shall share equally with the <br />Employer, the responsibility for applying this provisian of the Agreement. The OPBA <br />and all collective bargaining unit members shall not discriminate against any person or <br />persons, in any manner re(ating to their employment on the basis of race, color, <br />religion, national origin, marital status, pofitical affiiiation, disability, sex or age. "Sex" <br />includes a prohibition against sexual harassment. <br />SECTION 2: The Employer agrees not to interfere with the rights of employees to <br />become members of the OPBA, and there shall be no discrimination, interFerence, <br />restraint or coercion by or against any employee because of OPBA membership, or <br />lack of OPBA membership. <br />SECTION 3: The OPBA recognizes its responsibilities as a bargaining unit to members <br />and non-members alike, without discrimination, interterence, restraint ar coercion. <br />SECTION 4: The OPBA and the Employer recognize the right of all employee(s) to be <br />free to join or not join the OPBA and shall not coerce empioyee in any manner to join or <br />not join the OPBA. Employees who believe that the OPBA, the Employer, or any <br />member of the OPBA has attempted to coerce, intimidate or threaten them to join the <br />OPBA or not join the OPBA, shall file a written complaint with the Director of Public <br />Safety no later than thirty (30) days following the date of the last incident.
