ARTICLE 4: <br />DUES DEDUCTION AND FAIR SHARE <br />SECTION 1: The Employer agrees that it shall deduct the initiation fee, assessments <br />and regular monthly dues from the pay of regular full-time employees covered by this <br />Agreement upon receipt from the OPBA of individual written authorization cards which <br />have been voluntarily executed by the employee for that purpose and bearing the <br />employees signature. Any member of the OPBA shall have the right to revoke such <br />authorization during the following period: <br />Not less than thirty (30) calendar days but not sooner than forty-five (45) <br />calendar days prior to the expiration date of this collective bargaining agreement by <br />giving written notice to the OPBA with proof of service. Proof of service is defined to <br />mean that the written notice shall contain the name of the OPBA, the address to which <br />the written notice is to be delivered and method delivery was made. Delivery should be <br />made by U.S. Certified Mail, with requested receipt of delivery. A copy of the same <br />shall be provided to the office of the Director of Finance. <br />Any member of the OPBA shall have the right to file an application with the State <br />Employment Relations Board for a Religious Exemption. Such an application shall be <br />mailed to the State Employment Relations Board by the employee. A copy of the same <br />shall be provided to the office of the Director of Finance. <br />SECTION 2: Deductions of assessments, dues and fees shall be made during the first <br />pay period of each month and if an employee's pay for that period is insufficient to <br />cover OPBA assessments or dues, the Employer will make a deduction from the pay <br />earned in the next period or subsequent period. All deductions for assessments or dues <br />shall be accompanied by an alphabetical list of all employees for whom the deductions <br />have been made and shall be transmitted to the OPBA no later than thirty (30) days <br />following the end of the pay period in which the deductions are made. Upon receipt, the <br />OPBA shall assume full responsibility for the disposition of all funds deducted. <br />SECTION 3: The OPBA shall indemnify and save the Employer harmless from any and <br />all liabilities or damages which may arise from the performance of its obligations under <br />the provisions of this Article and the OPBA shall indemnify the Employer for any such <br />liability or damages that may arise from any action growing out of deductions, <br />commenced by an employee against the Employer or the Employer and the OPBA <br />jointly. <br />SECTION 4: All full-time bargaining unit employees who are not members of the OPBA <br />shall pay a fair share fee to the OPBA in the amount certified by the OPBA as being <br />a <br />. ????;
