ARTlCLE 1: <br />PREAMBLE <br />ARTICLE 1: This Agreement is entered into by and between the City of North Olmsted, <br />Ohio, hereinafter referred to as the "Employer" and the Ohio Patrolmen's Benevolent <br />Associafion, hereinafter referred to as the "OPBA". <br />This Agreement is intended to formalize the understandings reached between <br />the negotiating committees of the Employer and the OPBA, to establish certain terms <br />and conditions of employment for employees classified as Emergency Central <br />Dispatchers employed by the City of North Olmsted. <br />Further, the purpose of this Agreement is to promote cooperation and <br />harmonious relations between the Employer and its employees. <br />ARTICLE 2: <br />UNION REPRESENTATION <br />SECTION 1: The Employer recognizes the OPBA as the sole and exclusive <br />representative for the purpose of negotiating wages, hours, terms and other conditions <br />of employment for the employees of the Empioyer in the bargaining unit. Wherever <br />used in this Agreement, "bargaining unit" shall be deemed to include those individuals <br />employed by the Employer in the ciassification of full-time Emergency Centra! <br />Dispatcher. <br />SECTION 2: The Employer recognizes the OPBA for the purposes of collective <br />bargaining and all matters relating to the wages, hours and working conditions of all <br />members of the bargaining unit. <br />ARTICLE 3: <br />MANAGEMENT RIGHTS <br />SECTION 1: The Employer shall have the exciusive right, except to the extent <br />otherwise modified or limited in this Agreement, to manage the operations, control the <br />premises, direct the working force and maintain efficiency of the operations. Among the <br />Employer's management rights are the right to hire, transfer, discipline and discharge <br />for just cause, lay-off and promote; to promulgate and enforce work rules; to introduce <br />new equipment, methods of performing work, or facilities; to determine the size, duties <br />and qualifications of the work force, and the work schedules.
