Copies of any written statements and documents shall be provided to <br />the aggrieved party as well. Written grievances can not be resolved at S'I'EP 1 of the grievance <br />procedure. <br />In the event of an Employee's discharge from employment, the Grievance shall be submitted at <br />Step 3 with a written Grievance submitted to the Director of Fublic Safety wifihin ten (10) days of <br />the discharge ofthe Employee. <br />STEP 2- The Fire Chief shail remder a written decision within ten (10) days after receipt of the <br />Grievance. The fire chief may convene a hearing during that ten (10) day period with the <br />aggrieved party and the Association representative of the aggrieved party's choice. <br />STEP 3- If the Aggrieved Party initiating the Grievance is not satisfied with the written decision <br />of the Fire Chief at the cottclusion of Step 2, a written appeal of the decision may be filed with the <br />Director of Public Safety within ten (10) days from the date of the written decision rendered by the <br />Fire Chief at Step 2. Copies of the written decision shall be submitted with the appeal. <br />The Director of Pubtic Safety sha!l convene a hearing within ten (10) days of the receipt of the <br />appeal. The hearing wiIl be he[d with the Aggrieved Party and his Association representative. <br />The Director of Public Safety shall issue a written decision to the Employee and his representative <br />if requested, within ten (10) days frorn the date of the hearing. <br />STEP 4- If the Grievance is not satisfactorily settted at Step 3, the Association, may, within thirty <br />days after receipt of the Step 3 decision, submit the matter to arbitration. The Association shalt <br />natify the Employer of its intent to appeal the Grievance to arbitration in writing. Within ten (IU) <br />days, representatives of the Association, shalt send a written notice of its intent to azbitrate the <br />Grievance to the Federal Mediation and Conciliation Service. The Federal Mediation and <br />Conciliation Service shall submit a panel of flve arbitrators and tfie arbitrator shall be setected by <br />alternate striking within ten (10) days after receipt of the list. <br />(A) The arbitrator shall have no power or authority to add to, subtract from, or in any manner alter <br />the specific terms of this Agreement, or to make any award requiring the commission of any <br />act prohibited by law, or to make any award that itself is contrary to law or violates aay of the <br />terms and conditians of this Agreement. <br />15
