(B) The arbitrator shall hold a hearing within thirty days of the notification of appointment. He <br />shall establish the hearing time and place, but it shall be, where feasible, within the <br />jurisdiction of the City. <br />(C) Not later than five (5) days befnre the hearing, each of the parties shall submit to the arbitrator <br />and to the opposing party a written report summarizing the unresolved issue, the parties <br />requested method of resolution, aad the rationale for that resolution. <br />(D) All awards of the arbitrator and all pre-arbitration Grievance settlements reached by the <br />Association and the Employer shall be final, binding and conclusive on the Association and <br />the Employer. <br />(E) T'he fees of the arbitrator, expenses of ineeting rooms and stenographic service shall be borne <br />equally by the parties. <br />7.4 A Grievance may be withdrawn without prejudice at any time. <br />7.5 Both the Employer and the Association, shall in good faith, make every atternpt to resolve all <br />Grievances at the iowest step in the Grievance Prooedure. <br />ARTICLE VIII <br />PERSONNEL REDUCTIUN <br />8.1 When a position in the Fire Department is abolished or an adrninistrative layoff is ordered, and the <br />position is above the rank of Fire Fighter, the least Senior officer in such rank shall be demoted to <br />the next lower rank and ttte least Senior officer in such Iower rank shall be demoted, and so on <br />down until the least Senior person has been reached and he shall be laid off. <br />8.2 When a Fire Fighter's position, or Fire CadetJParamedic, has been abolished aud is re-established, <br />or has beea administratively laid offaad subsequently a decision to refiIl the position is made, the <br />person who previously heid that position shall be entitled to that position. If a position above the <br />rank of Fire Fighter is aboiished, then re-established, or administrativeiy laid off, then <br />subsequently a decision to refill is made, the person who previousty held that position shall be <br />entitled to that position. No new Employees shall be hired nntil all laid off Employees within that <br />16
