? <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2004 - 105 <br />BY: Mayor Musial <br /> <br />A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO <br />AN AGREEMENT WITH THE NORTI-I OLMSTED CITY SCHOOL <br />DISTRICT IN ORDER TO OBTAIN BUS TRANSPORTATION <br />SERVICES FROM THE SCHOOL DISTRICT FOR THE CITY'S <br />SUMMER 2004 RECREATION AND PLAYGROUND PROGRAM, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, the City requires transportation services in order to implement its <br />Summer 2004 recreation and playground program; and <br />WHEREAS, it is the recommendation of the Director of Public Safety that the <br />City enter into an agreement with the North Olmsted City School District to provide bus <br />transportation as needed for said program; <br />NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF 4HI0: <br />SECTION 1: That the Mayor be and is hereby authorized to enter into a contract <br />with the North Olmsted City School District, which will require the School District to <br />provide bus transportation services to the City for its Summer 2004 recreation and <br />playground program. Said contract shall be in the form of the Agreement that is attached <br />to this legislation as Exhibit A, with only such changes therein as are not substantially <br />adverse to the City and which are approved by the Director of Law. The character of any <br />such changes as not being substantially adverse to the City sha11 be evidenced <br />conclusively by the execution of the agreement by the Mayor and the approval of the <br />agreement by the Director of Law. <br />SECTION 2: That this Council has previously appropriated sufficient funds for <br />expenditures made by the City pursuant to the said contract. <br />SECTION 3: That this Resolution is hereby declared to be an emergency <br />measure immediately necessary for the preservation of the public health, safety and <br />welfare, and for the reason that it is necessary that this Resolution go into effect <br />immediately because the summer recreation and playground program is scheduled to <br />begin on June 21, 2004, and further provided it receives the affirmative vote of two-thirds <br />of all members of Council, it shall take effect and be in force immediately upon its <br />passage and approval by the Mayor. <br />
