AGREEMENT <br />THIS AGREEMENT rnade this 4`" day of June, 2004, by and between the City of North <br />Olmsted, hereinafter referred to as "City", and the Board of Education of the North Olmsted City <br />School District, hereinafter referred to as "School". <br />WITNESSETH: <br />. WHEREAS, the City and the School with to join and cooperate in the operation of a <br />Summer Recreation Playground Programs; and <br />WHEREAS, the School owns and operates school buses, employs drivers, and is willing, <br />for adequate cons-ideration, to agree to make buses and dnvers available during the summer <br />months to provide such transportation service; and <br />NOW, THEREFORE, the parties hereto, in consideration of the fees and the covenants <br />set forth below, agree as follows: <br />l. The School shall provide school buses and drivers to create a transportation system <br />for surnmer recr-eation and playground program beginning June 21, 2004 and ending <br />July 30, 2004. During that period, the School shall maintain and service the buses <br />and pay a11 fuel costs. In addition, the Schools shall maintain liability insurance <br />coverage for claims arising out of, or in connection with, the operation of the buses <br />by its drrvers, covering the Board and its drivers with limits not less than $100,000 <br />for death or bodily injury to one person and $300,000 for death ar bodily injury for <br />each occurrence. Provided, the Schoo] does not, and shall not be deemed to waive its <br />immunity by virtue of the existence of this insurance coverage. <br />2. The Parks and Recreation Director for the City shall furnish the Manager of <br />Transportation Services for the School with a complete schedule of transportation <br />needs, destinations, and times needed for the Summer Recreation, Playground <br />Programs. The Manager of Transportation Services for the School shall schedule all <br />vehicles and drivers to implement this service.
