CITY OF NORTH OLMSTED ORDINANCE NO. 2004 -104 BY: Council Member Gareau. AN ORDINANCE AMENDING SECTION ONE OF ORDINANCE NO. 2004-18, WHICH PROYIDED FOR THE DIRECTOR OF LA W TO RETAIN THE LAW FIRM OF JOHNSON, ANGELO & COLAL UCA, LLC, AS OUTSIDE COUNSEL TO ASSIST THE CITY IN LABOR NEGOTIATIONS, SO AS TO AUTHORIZE AN ADDITIONAL EXPENDITURE OF FUNDS PURSUANT TO THE SAID CONTRACT ENTERED INTO BETWEEN THE CITYAND SAID LAW FIRM, AND DECLARING AN EMERGENCY. WHEREAS, this Council, on February 12, 2004, adopted Ordinance No. 2004-18, which authorized the Director of Law to retain the law firm of Johnson, Angelo & Colaluca, LLC, as outside counsel to assist the City in current labor negotiations, and authorized a maximum expenditure of Thirty Thousand Dollars to said law firm for the rendering of such legal services; and WHEREAS, as a result of the reeent filing of unfair labor practices and grievances by one of the City's employee unions, and a bargaining impasse between the City and another of the City's employee unions, all of which are related to the labor- management matters for which Johnson, Angelo & Colaluca, LLC, were initially retained, the Director of Law has recommended that additional funds be provided in order to enable the said law firm to continue and complete its representation of the City this year in these labor-management matters; and WffEREAS, it is accordingly the desire of this Council to amend Ordinance No. 2004-18 to provide for the expenditure of additional funds for legal services rendered by Johnson, Angelo & Colaluca, LLC, up to a maximum of an additional Thirty Thousand Dollars in order to complete its representation of the City in this matter, and further to authorize the Mayor, subject to approval of the Board of Control, to enter into an amended Agreement with Johnson, Angelo & Colaluca, LLC; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF NORTH OLMSTED, COUIVTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That Section 3 of Ordinance No. 2004-18, which presently reads as follows: "SECTION 3: That expenditures pursuant to said contract shall not exceed Thirty Thousand Dollars ($30,000) without further authorization of this Council."
