Ordinance No. 2004-104 <br />Be amended, and, as amended, shall read in its entirety as follows: <br />SECTION 3: That expenditures pursuant to said contract shall not exceed <br />Thifty Siz Thousand Dollaxs ($60,000) without further authorization of <br />this Council. <br />SECTION 2: That the Mayor be and hereby is authorized, subject to approval of <br />the Board of Control, to enter into an amended Agreemerrt with the Law Firm of Johnson, <br />Angelo & Colaluca, L.L.C., providing for a maximum expenditure of Sixty Thousand <br />Dollars ($60,000.00) for legal services required in connection with the City's current <br />labor negotiations with its City employee unions, including the prosecution and defense <br />of unfair labor practices and grievance arbitrations, the subject matter of which are <br />related to management rights issues also raised in said labor negotiatians. Said contract <br />shall be in the form and substance of the First Amended Contract for Qutside Legal <br />Counsel, attached to this Ordinance as "Exhibit A," with only such changes therein as are <br />not substantially adverse to the City and which are approved by the Director of Law. The <br />character of any such changes as not being substantially adverse to the City shall be <br />evidenced conclusively by the execution of the agreement by the Mayor and the approval <br />of the agreement by the Director of Law. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, health, safety and <br />welfare of the City of North Olmsted, Ohio and for the further reason that it is necessary <br />that this Ordinance go into effect immediately so that said outside law firm may be timely <br />compensated for legal services provided to the City in the month of May 2004 and <br />thereafter, and further provided that it receives the affirmative vote of two-thirds of alI <br />members of Council, it shall take effect and be in force immediately upon its passage and <br />approval by the Mayor. <br />PASSED: <br />? <br />ST.• BARBARA L.
