<br />Ordinance No. 2003-11 <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY QF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Director of Public Safety is not required to comply with the RFP <br />procedures set forth in Sections 111.03 et seq. of the Codified Ordinances, because the subject <br />renewal agreement meets the permitted exceptions in Section 111.08(A)(1) and (3) of said <br />Codified Ordinances, and the Mayor accordingly be and he hereby is authorized to enter into a <br />renewal agreement with TAC Computer, Inc., to provide maintenance service for the computers <br />and software programs operated by the North Olmsted Police Department for a one-year term <br />retroactively to January 1, 2004, which shall be in the form and substance of the attached "Flat <br />Rate Service Agreement," marked as Exhibit A. <br />SECTION 2: That the City is not authorized to expend, pursuant to said Agreement, an <br />amount that exceeds $15,000. <br />SECTION 3: That this Council declares that sufficient funds have been appropriated for <br />the expenditures relating to the subject renewal agreement and hereby ratifies and approves any <br />payments made by the Director of Finance to TAC Computer, Inc. during the period January 1, <br />2004, through the effective date of this Ordinance, that are consistent with the provisions of the <br />subject renewal agreement. <br />SECTION 4: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is necessary that this Ordinance immediately go into effect so that <br />operations of the Police Department which are vital to the safety of the community are not <br />adversely affected by a gap in computer maintenance service, and further provided it receives the <br />affirmative vote of two-thirds of the members of this Council, it shall take effect and be in force <br />immediately upon its approval by the Mayor. <br />PASSED: ` 1-z.
