CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2004-12 <br />BY: Mayor Musial <br />A ORDINANCE DISPENSING WITH AN RFP PROCESS AND <br />AUTHORIZING THE MAYOR, FOLLOWING APPROVAL BY <br />THE BOARD OF CONTROL, IF NECESSARY, TO RENEW THE <br />CITY'S AGREEMENT WITH N. E. DEL GIUDICE ARCHITECTS, <br />INC., TO SERVE AS BACK-UP PLANS EXAMINER FOR THE <br />NORTH OLMSTED BUILDING DEPARTMENT, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, since the 2002 retirements of the City Engineer Deichmann and Assistant <br />City Engineer Griffith, the City of North Olmsted has not had a state certified Class II Plans <br />Examiner on staff, and has been required to contract for the necessary services of a plans <br />examiner and back-up plans examiner; and <br />WHEREAS, this Council, on March 18, 2003, adopted Resolution No. 2003-46, <br />authorizing the Mayor to enter into a six month contract with N. E. Del Giudice Architects, <br />Inc. to serve as the City's back-up plans examiner; and <br />WHEREAS, said contract with N. E. Del Giudice Architects, Inc. expired on <br />October3, 2003, and it is the desire and recommendation of the Director of Public Safety that <br />the City's contract with N. E. Del Giudice Architects, Inc. be renewed retroactively for a <br />twelve month period from October 4, 2003 through October 3, 2004; and <br />WHEREAS, the City Charter does not require competitive bidding in order to award <br />such a public contract because it is for professional services, but does require approval of the <br />Board of Control because expenditures under the contract may exceed $15,000.00; and <br />WHEREAS, Section 111.03 et seq. of the City's Codified Ordinances provides that <br />such renewal agreements with professionals with whom the City has a continuing relationship <br />may be renewed without complying with the usual RFP process; and <br />WHEREAS, it is accordingly the desire of this Council to authorize the Mayor, subject <br />to approval by the Board of Control, if necessary, to renew the City's agreement with N. E. <br />Del Giudice Architects, Inc. to serve as Back-up Plans Examiner for the City of North Olmsted <br />Building Department, for an additional twelve month period as recommended by the Director <br />of Public Safety; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO:
