<br /> <br />Ordinance No. 2004-12 <br />SECTION 1: That, upon approval of the Board of Control, if necessary, the Mayor be <br />and is hereby authorized to enter into a renewal agreement with N. E. Del Giudice Architects, <br />Inc. to serve as Plans Examiner for the City of North Olmsted Building Department for an <br />additional twelve month period retroactive to October 4, 2003. Said agreement sha11 be in the <br />form of the Agreement attached to this Ordinance as "Exhibit A," with only such changes <br />therein as are not substantially adverse to the City and which are approved by both the Mayor <br />and the Director of Law. The character of any such changes as not being substantially adverse <br />to the City sha11 be evidenced conclusively by the execution of the agreement by the Mayor and <br />the approval of the agreement by the Director of Law. <br />SECTION 2: That this Council declaxes that sufficient funds have been appropriated <br />for the expenditures relating to the subject renewal agreement and hereby ratifies and approves <br />any payments made by the Director of Finance to N. E. Del Giudice Architects, Inc. during the <br />period October, 2003, through the effective date of this Ordinance, that axe consistent with the <br />provisions of the subject renewal agreement. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public peace, health, safety and welfare, of <br />this City and for the further reason that this Ordinance is required to be immediately effective <br />so that the City's Building Department does not lose its State certification and may legally <br />review plans submitted for commercial structures in the City, when the City's primary plans <br />examiner is not available or is conflicted; and further provided it receives the affirmative vote <br />of two-thirds of all members of Council, it sha11 take effect and be in force immediately upon <br />its passage and approval by the Mayor. <br />PASSED: First Reading: v <br />Second Reading: <br />Third Reading.• <br />Committee: <br />?.. = <br />ATTFSY? ; -- <br />? , <br />??- <br />_ .,. <br />J?k ARASMAN THOMAS E.
