? *n <br />10? <br />? <br />City of North Olmsted - Part One RFP Background Information 8 <br />may be incorporated into a contract between the City and the successful <br />Proposer. Provided, however, that nothing in this RFP or any document <br />generated in respanse to this RFP shall be binding upon the City unless or until <br />such terms is incorporated into a contract and signed by the 'City. and the <br />successful Proposer. <br />D. General Contractual Conditions <br />The City will award the contract to the responsible and eligible Proposer whose <br />proposal, conforming to this RFP, and guarantee mechanisms or bonds, is <br />deemed by the City to be in the City's best interest; provided, however, that the <br />City shall not be required to award a contract to any Proposer, if the City deems <br />this to be in the City's best interest. <br />E. Incurring Costs <br />The City shall not be liable for any costs incurred by Proposers in preparing, <br />submitting or presenting proposals, or in satisfying any demonstration or other <br />requirements. The City shall not reimburse any costs incurred by Proposers in <br />anticipation of being awarded the contract under this RFP. Only the Mayor and <br />City Council via resolution or acceptance of a specific budgetary item can legally <br />obligate the City for the expenditure of public funds for this purpose. Prices <br />quoted in Proposals shall include all personnel, supplies, services and equipment <br />and everything necessary for the System's complete operation. <br />F. Systems Responsibility <br />Notwithstanding the details presented in this RFP, it is the responsibility of the <br />Proposer to verify the completeness of the hardware, software, specifications, <br />systems, elements, ability to interface, functionality and suitability of products <br />and services to meet the intent af this RFP. Any additional hardware, software, <br />services, etc., required after installation, even if not specifically mentioned <br />herein, shall be -provided by the Proposer without claim for additional payment, <br />it being understood that a complete operating system is required. The successful <br />Proposer shall be obligated to provide a System which meets all guarantees in its <br />Proposal for the price contained therein. <br />G. Financial Capability <br />The Proposer, as part of their submission, must prove that their firm has the <br />financial capability to supply and maintain the System. <br />H. Hardware Flatforms <br />The City is open to considering the fallowing hardware platforms: NT and Unix <br />I. Communications <br />The City is open to suggestions as to remote communication options. <br />
