I *, <br /> <br />City of North Olmsted - Part One RFP Background Information 16 <br />The insurance may also be written on the comprehensive general <br />liability form. Comprehensive general liability limits shall <br />not be less than the following: <br />Bodily Injury Occurrence $1,000,000 <br />Property Damage Occurrence $1,000,000 <br />PersonalInjury Aggregate $1,000,000 <br />4. UMBRELLA <br />This insurance shall be written to protect the successful Proposer and the City <br />against all claims in excess of the underlying general liability, automobile and <br />workers' compensation coverages. The umbrella limits shall not be less than the <br />following: <br />Limit of Liability Aggregate $5,000,000 <br />The City must be an additional insured under the umbrella. The successful <br />Proposer and all subcontractors shall furnish the City, prior to any award of an <br />agreement, certificates of insurance evidencing the required coverages. Separate <br />insurance certificates need not be furnished if the successful Proposer and all <br />subcontractors have previously filed with the City certificates which are <br />currently in effect. No work shall be performed under this Contract by the <br />Proposer or its sub-contractors after expiration or cancellation of the insurance <br />set forth above <br />V. Remedies, Attorney's Fees and Costs <br />All remedies provided in this RFP shall be deemed cumulative and additional, and not <br />in lieu of or exclusive of each other or of any other remedy available at law or in <br />equity arising hereunder. In the event that any proceeding at law or in equity arises <br />hereunder or in connection herewith (including any appellate proceedings or <br />bankruptcy proceedings), the prevailing party shall be awarded costs, reasonable expert <br />witness fees, reasonable attorney's fees (including reasonable fees and charges for the <br />services of paralegals or other personnel who operate for and under the supervision of <br />such attorneys and whose time is customarily charged to clients) and any other <br />expenses incurred in connection with such legal or equitable proceedings. <br />
