City of North Olmsted, NY / xxx xxxx 46 <br />first year of this Agreement will be furnished in accordance with the manufacturer's <br />provisions and VENDOR assures that all VENDOR application software will be <br />modified to accommodate the new versions or releases. VENDOR guarantees that the <br />hardware offered is standard new hardware, latest model of regular stock product with <br />all parts regularly used with the type of hardware offered; also, that no attachment or <br />part has been substituted or applied contrary to the manufacturer's recommendations <br />and standard practice. Every unit delivered must be guaranteed against faulty material <br />and workmanship for a period of at least one year unless otherwise specified. If <br />during this period, such faults develop, the unit or part affected is to be replaced by <br />VENDOR at VENDOR's expense and without cost to CITY, including but not limited <br />to all labor, materials and shipping costs. Where accessories are to be supplied, they <br />must be compatible with the remainder of the hardware. All hardware and the <br />installation thereof shall conform to all current applicable Federal, State and Local <br />codes, including OSHA standards. Full hardware with all appurtenances complete shall <br />be furnished and delivered. Where any part is not described, it shall be understood <br />that what is usually provided in the manufacturer's stock product shall be furnished. <br />C. OPERATING SYSTEM SOFTWARE WARRANTIES <br />VENDOR warrants that all software supplied in the proposal is compliant with the <br />vendor's RFP. <br />D. DELIVERY AND INSTALLATION <br />The VENDOR initially shall make delivery of the CPU and related components to <br />CITY at CITY's designated locations as defined in the proposal and attachments. After <br />delivery, all payments for hardware by CITY to VENDOR, including the CPU and <br />related components, shall be made after the CPU and related components have been <br />completely installed at CITY at VENDOR's expense, except as otherwise agreed, and <br />accepted by CITY. Installation shall include delivery, unloading, uncrating, <br />assembling, setting in place, fastening to walls, floors, counters or other structures or <br />fixtures where required and the connection of all components of the system and all <br />other related work, including the final "burn-in" of the system. CITY will procure <br />from VENDOR an installation service for cabling set-up, etc. of remote peripherals <br />such as printers, terminals, communications equipment, and personal computers as <br />defined in Exhibits. <br />To as great extent as practical, all existing cabling from any existing computer system <br />will be utilized. Cabling for additional workstations, printers and :LAN wi11 be <br />installed by CITY at its expense. VENDOR will provide all cables and connectors and <br />will inspect cable installation and connect all peripherals. VENDOR is responsible for <br />insuring the functionality of all peripherals. CITY shall provide, at its own expense, <br />electrical service to the point or points required by VENDOR, and VENDOR shall <br />make aIl connections to that service.
