CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2004-43 <br />BY: Mayor Musial <br />AN ORDINANCE PROVIDING FOR THE SUBMISSION TO <br />THE ELECTORS OF THE CITY OF NORTH OLMSTED OFAN <br />AMENDMENT TO ARTICLE VII, SECTION 6 OF THE <br />CHARTER OF THE CI7'Y OF NORTH OLMSTED TO REQUIRE <br />THAT MEMBERS OF THE CITYLANDMARKS COMMISSION <br />HAVE THE QUALIFICATIONS NECESSARY TO QUALIFY <br />THE COMMISSION AS AN HISTORIC PRESERVATION <br />REVIEW COMMISSION FOR FEDERAL FUNDING <br />PURPOSES, AND DECLARING AN EMERGENCY, AS <br />AMENDED. <br />WHEREAS, in order to achieve status as a certified local government ("CLG") for purposes <br />of receiving federal funding under the National Historic Preservation Act, the City Landmark <br />Commission must be composed of a number of inembers holding certain professional qualifications; <br />and <br />WHEREAS, it is the desire of this Council to submit to the electors a proposal to amend <br />Article VII, Section 6 of the Charter (City Landmarks Commission) so that qualifications far <br />membership on the City's Landmark Commission would automatically be updated whenever changes <br />were made, from time to time, in the federal National Historic Preservation Act; and <br />WHEREAS, this proposal was submitted by this Council to the Charter Review Commission <br />for review and recommendation in accordance with Article XIV, Section (b)(2) of the City Charter, <br />and, within 60 days of the date of referral, the Commission on the 14th day of June, 2004, filed a <br />written report with the Clerk of Council in which the Commission recommended for the proposal as <br />amended; and <br />WHEREAS, this Council has adopted this Ordinance, as required by state law, no sooner than <br />120 days, and no later than 60 days, prior to the date of the election at which the issue will be voted <br />upon by the electorate; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLIKSTED, COUNTY OF CUYAHOGA, OHIO, TWO-THIRDS OF ALL MEMBERS <br />CONCURRING THAT: <br />
