CITY OF NORTH OLMSTED ORDINANCE NO. 2004-43 BY: Mayor Musial AN ORDINANCE PROVIDING FOR THE SUBMISSION TO THE ELECTORS OF THE CITY OF NORTH OLMSTED OFAN AMENDMENT TO ARTICLE VII, SECTION 6 OF THE CHARTER OF THE CI7'Y OF NORTH OLMSTED TO REQUIRE THAT MEMBERS OF THE CITYLANDMARKS COMMISSION HAVE THE QUALIFICATIONS NECESSARY TO QUALIFY THE COMMISSION AS AN HISTORIC PRESERVATION REVIEW COMMISSION FOR FEDERAL FUNDING PURPOSES, AND DECLARING AN EMERGENCY, AS AMENDED. WHEREAS, in order to achieve status as a certified local government ("CLG") for purposes of receiving federal funding under the National Historic Preservation Act, the City Landmark Commission must be composed of a number of inembers holding certain professional qualifications; and WHEREAS, it is the desire of this Council to submit to the electors a proposal to amend Article VII, Section 6 of the Charter (City Landmarks Commission) so that qualifications far membership on the City's Landmark Commission would automatically be updated whenever changes were made, from time to time, in the federal National Historic Preservation Act; and WHEREAS, this proposal was submitted by this Council to the Charter Review Commission for review and recommendation in accordance with Article XIV, Section (b)(2) of the City Charter, and, within 60 days of the date of referral, the Commission on the 14th day of June, 2004, filed a written report with the Clerk of Council in which the Commission recommended for the proposal as amended; and WHEREAS, this Council has adopted this Ordinance, as required by state law, no sooner than 120 days, and no later than 60 days, prior to the date of the election at which the issue will be voted upon by the electorate; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLIKSTED, COUNTY OF CUYAHOGA, OHIO, TWO-THIRDS OF ALL MEMBERS CONCURRING THAT:
