SECTION 6. USE. <br />During the term of this Lease Agreement, the Trustees shall have the exclusive ri_Tht to use the <br />Leased Property as a free public library. The Leased Property shall be open to free use by residents of the <br />City of North Olmsted and Cuyahoga Countv, subject to the Rules and Regulations of the Trustees, includinQ <br />penalty charQes for late return of circulating books and other library materials, and the Leased Property shall <br />be occupied by the Trustees solely for the operation of a free public library in accordance with the Rules and <br />Regulations of the Trustees. <br />The Trustees shall stock the New Buildin? with appropriate volumes of books and other <br />library materials as promptly and in such numbers as space available and orderly acquisition thereof pernut. <br />The Trustees shall staff and operate the Leased Property on a basis comparable with its <br />branch library operations elsewhere in Cuyahoga County, due consideration bein? aiven to the financial <br />circumstances of the Trustees, the population of the area served by the Leased Property, and the requirements <br />of the patrons of the Leased Properly. <br />SECTION 7. FUR1vITURE, FURNISHINGS AiND EQUIPMENT. <br />All fumiture, fumishings, shelving and equipment purchased by the City for the Leased <br />Property shall be and shall remain the properry of City. The Trustees shall maintain, repair and replace such <br />fumiture, furnishings, shelving and equipment throughout the term of this Lease Agreement or any renewal <br />thereof. <br />When the Trustees determine, in their discretion, that any personal property provided by the <br />City for the Leased Property needs to be replaced due to obsolescence, wear and tear, or for the proper <br />operation of the Leased Property, the Board of Trustees shall give written norice to the City of the proposed <br />disposition of property, and the City shall have the option of removing the identified property from the <br />Leased Property not sooner than the seventh day and not later than the thirtieth day after that notice is given. <br />If the City has nat removed the property proposed to be disposed of by the thirtieth day after the aiving of that <br />notice, the City shall not have any further right to the property, and the Trustees may dispose of it in such <br />manner as they may determine. <br />All new and/or existing library materials, personal property, equipment, furniture, furnishings <br />and shelving purchased by the Trustees aze and shall remain the property of the Trustees, except such <br />furniture, furnishings, shelving and equipment provided by the trustees in replacement of fumiture, <br />furnishings, shelving and equipment provided by the City (Replacement Property), which Replacement <br />Property shall be property of the City. <br />SECTION 8. MODffICATIONS TO LEASED PROPERTY. <br />The Trustees shall, in all respecu and at their sole expense, maintain the Leased Properry in <br />good condition, repair and state of cleanliness, and shall make all repairs and replacements as necessary. No <br />structural changes to or of the Leased Property shall be made by the Trustees, and no portion of the Leased <br />Property shall be removed by the Trustees, except with the prior written consent of the City. The Trustees <br />shall keep the Leased Property free of any liens, claims or other encumbrances by materialmen, suppliers or <br />other laborers arising out of the use or improvement of the Leased Property by the Trustees. <br />-4-
