believes that the employee on layoff sta.tus has the skills necessary, knowledge and the ability <br />to perform the duties of the position. Should the employer recall a laid off employee and the <br />employee fails to satisfactorily demonstrate the skills necessary, the knowledge and ability to <br />employce fails to satisfactorily demonstrate the skills necessary, the knowledge and ability to <br />satisfactorily perform the required job task within seven (7) days, said employee shall be placed on layoff <br />status and the next less senior employee on layoff status shall be recalled. Again, this employee must <br />also satisfactorily perform and demonstrate the skills necessary, knowledge and ability to perform the job <br />task. Should the employee fail to do so, he shall be placed back on layoff status. An employee on layoff <br />status will be given notice of his recall by U.S. Certified Mail, to the last known address of record. <br />B. If an employee laid off as prescribed within the aforementioned section enters in the "active service" <br />of the U.S. Armed Forces, such period of service shall nor be counted in the recall period. The recall <br />period is twenty-four (24) months for such employees. The minimum requirements as a member of the <br />Reserve does not constitute "active service" for the purpose of this section. <br />C. The recalled employee shall within seven (7) calendar days following the date of receipt for <br />the attempted date of delivery of such notice to appear in person and meet with the General Manager of <br />the Transit Department or his designee. Failure on the part of the recalled employee to appear as reyuired <br />shall result in a loss of any present and future right to recall. Employees on recall status shall retain the <br />right to recall for a period of time equal to his seniority but in no event shall any employee retain recall <br />rights beyond twenty-four (24) months following the da.te of layoff. It is the responsibility of the <br />employee to inform the employer of his correct address. When an employee meets with the General <br />Manager within the aforementioned time period and declines to return to work or fails to respond within <br />the set time period, his name shall be removed from the recall list. <br />D. The employer shall hand deliver a written layoff notice to the affected employee(s) on his <br />regular shift fourteen (14) days prior to the effective date of the layoff. Employees who have completed <br />their probationary period shall be permitted to bump the least senior full-time employee within the <br />Transit Department, providing the employee with the greater seniority can satisfactorily demonstrate to <br />the employer that he possesses the necessary skills along with the knowledge and ability to perform the <br />required job task of the position he wishes to bump. Upon receipt of the layoff notice as described <br />above, the affected employee (s) wishing to bump shall immediately request the employer to provide him <br />a"bump form". The employee shall complete the form and return the same to the General Manager or <br />his designee a minimum of seven (7) days following receipt of the layoff notice. The employer shall <br />review the completed form and based on the employees work experience demonstrate that he can <br />perform the task required of the bump position, the General Manager or his designee shall authorize and <br />approve the bump. The employee shall be required to satisfactorily demonstrate that he can perform the <br />job task within seven (7) days. Should the employee fail to satisfactorily perform the job task with the <br />time limit set above, he shall be placed on layoff status effective at the end of the shift of the 7th day. <br />Employees who are placed on layoff status under these conditions shall forfeit and not maintain further <br />rights to bump. T'he employee shall, however, maintain recall rights as cited within Sectian 14.05 sub- <br />section A and B. The least senior full- time employee who has received a layoff notice may be pernutted <br />to bump the most senior part-time employee with the Transit Department providing all of the terms and <br />conditions described within this Article have been met by the employee. Any employee (s) exercising the <br />condition stated within this section shall have his full-time seniority frozen effective the date listed on the <br />layoff notice and shall retain such full-time seniority for a period of time not to exceed that which is <br />listed in Section 14.05 C of the Article for the purpose of recall to full-time status. Any further bumping <br />by a fuli-time employee into a part-time position shall use a"bump back" procedure, i.e. the first full- <br />time employee who bumped into the most senior part-time position shall be entitled to bump back to the <br />second most senior part-time position should another former full-time employee subsequently bump back
