(Example: Mondays, Frida.ys, day after payday, etc.) <br />Section 18.16 Any employee scheduled to work on a holiday who reports sick shail be charged sick <br />leave for that holiday, provided the proper NOMBL medical form has been completed and <br />shall forfeit his right to receive the holiday pay. If the employee has no sick leave or daes not <br />have the proper NOMBL medicai form completed, he shall receive no pay for that day. <br />ARTICLE 19 <br />LEAVES OF ABSENCE & FUNERAL LEAVES <br />Section 19.01 All employees shall be entitled to take a personal leave of absence with the approval of <br />the Service Director and under the terms and conditions as he sets forth, whitch <br />approval shall not be unreasonably withheld. Any leave of absence for personal reasons, shall not, <br />however, excced a ninety (90) day period. Said employee in order to maintain any and all benefits which <br />are paid by the City shall be required to pay the Finance Director, the cost of said benefits <br />in advance on a monthly basis. The maximum pernussible leave of absence for any reason shall <br />be ninety (90) days. The written request to the Service Director must clearly explain the reason for the <br />personal leave of absence and be specific as to the dates required. <br />(a) Special circumstances may occur for an employee to make application to the <br />Service Director for a leave of absence; whereby this Iea.ve will not affect the <br />employee's seniority as stated in Section 14.01. This situation wilt not be <br />precedent setting for past or future ieave of absence requests granted by the city. <br />Section 19.02 Any employee who is required to be away from work due to sickness shall be entitled to <br />use up sick leave which has been accumulated, according to the rates as specified in <br />Sec. 18.05, and Sec. 18.06. When an employee has exhausted all accumulated sick leave, then that <br />employee may continue on unpaid sick leave only if he or she qualifies for such additional leave under the <br />federal Family Medical Leave Act (FMLA). During said additional period for the length of time <br />permitted by FMLA, said employee, in order to maintain any and all benefits which are paid by the City, <br />and which the City is not required to continue to pay for while the employee is on FMLA leave, shall be <br />required to pay the Finance Director, the cost of said benefits in advance on a monthly basis. If the <br />employee does not qualify for continued sick leave under FMLA, he ar she may convert their leave to a <br />personal leave of absence pursuant to the provisions of Section 19.01 and to the extent permitted by <br />Section 19.01. <br />Section 19.03 After the leave of absence specified in Section 19.01 and 19A2 has terminated, <br />the employee shall report to the General Manager for work. Ifthe employee fails to do so, the employee <br />sha11 be terminated. This section shall not affect the application of Worker's Compensation statute. <br />Section 19.04 A fu11-time employee shall be granted time off with pay (not to be deductei <br />from the employee's sick leave) for the purpose of attendittg the funeral of a member of the employee's <br />family. Each futl-time employee shall be entitled to three (3) work days off, if necessary, for attending <br />locat funeral services of inemhers of his immediate family, or up to five (5) work days off, if necessary, <br />for the out-of-state funeral of a member of the immediate farnily. Immediate family, for purposes of this <br />section is defined as spouse, son, daughter, brother, sister, parent or grandparent, father-in-law, mother- <br />in-law, son-in-law, daughter-in-law, step-father, step-mother, step-sister, step-brother, step-son, "d <br />stepdaugl2ter, half-brother, and half-sister. The Employer reserves the right to request proof or <br />certification from the employee prior to payment of the days off as described in this section. <br />17
