<br />Section 32.04 As an exception to Section 32.03 above, any full-time employee who retires and <br />receives a pension, or dies prior to December 1 st of the payment year shall be eligible to receive a <br />longevity payment for that year based upon the proration scheduIe set forth above. <br />Section 32.05 No employee that is hired by the NOMBL after July 31, 2003, other than a certain three <br />full-time operators who are on layoff status at the time of the execution of this collective bargaining <br />agreement, shall be eligible for any of the longeviry payments set forth in the above sections. <br />ARTICLE 33 <br />OVERTIME <br />Section 33A1 Overtime pay for all employees except those in the classification of bus driver shall <br />be at the rate of time and one-half for all hours worked in excess of eight (8) hours in one day or forty <br />(40) hours in one week. Hours worked shall include vacation time and paid holiday time in addition to <br />the time actually worked. Overtime will be paid to the nearest minute. <br />Section 33.02 Overtime pay for employees in the classification of bus driver shall be in accordance <br />with the GCRTA route schedules and past Employer practices. <br />Section 33.03 In the computa.tion of weekly overtime, for all employees, recognized hotidays shall <br />be considered as time worked, except where the holiday coincides with the scheduled day off of the <br />employee. <br />Section 33.04 Any full-time maintenance employee who is called in for overtime work shall be <br />guaranteed a minimum of three (3) hours of overtime pay. <br />Section 33.05 Any futl-time operator or dispatcher/driver who is called or scheduled for overtime <br />work on his day off, shall be guaranteed a minimam of three (3) hours or more of overtime pay. <br />Section 33.06 When an employee agrees to work on his scheduled day off, he shall be paid at the <br />overtime rate of time and one-half. <br />Section 33.07 Any extra operator overtime work not assigned (after assignment to extra list and <br />miss operators) shall be presented, if three (3) hours ar more, according to Appendix B. <br />Section 33.08 The employer shall be the sole judge of the necessity of overtime for operators. In the <br />case of bus operators on Holiday situations (due to the Holiday public transit service obligations of the <br />employer) the last five (5) in senioriry cannot waive overtime and a refusal to work may make this <br />employee subject to insubordination. <br />Section 33.09 The employer shall endeavor, to make generally equitable distribution of overtime <br />work among maintenance personnel within each classification who are capable of performing the work. <br />The employer shall be the sole judge of the necessity of overtime work to be performed by Maintenance <br />personnel and the employer shall give advance notice to the extent practicable where such overtime is <br />required. Maintenance overtime shall be offered by rota.tion, by classification. Maintenance personnel <br />may refuse to work an overtime assignment, however any refusal or failure to work the overtime shall be <br />credited as if he had warked for the pwpose of distribution. If it is deternuned by the employer that an <br />insufficient number of maintenance personnel have not voluntarily accepted an offer to work an overtime <br />assignment, the employer shall have the right to require an appropriate number of maintenance personnel <br />29 <br /><x- . ?????• ? , ?.. _ ?
