CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2004 - 63 <br />BY: Mayor Musial. <br />AN ORDINAIVCE DISPENSING WITH AN RFP PROCESS AND <br />AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT WITH <br />COMPUHENSIYE BUSJNESS SOLUTIONS, ING TD MAINTAIN ICES <br />PROGRAM AND IPAC POCKET UNITS FOR THE BUILDING <br />DEPARTMENT, AND DECLARING AN EMERGENCY. <br />WHEREAS, the City entered into an Agreement with Compuhensive Business Solutions, <br />Inc. (herein CBS, Inc.) in 1996 to install, license, train, and maintain an Integrated Codified <br />Enforcement System (herein ICES) computer system for efficient operations in the Building <br />Department, including the provision of Il'AC pocket units for integration; and <br />WHEREAS, the City depends upon CBS, Inc. as the exclusive supplier of hardware and <br />software updates, modification, enhancement and maintenance of the ICES system, including the <br />integrated hand hela units, pursuant to the terms of the original license agreement; and <br />WHEREAS, due to proprietary consideration and licensing constraints, it is not feasible <br />nor appropriate to solicit a maintenance agreement for the ICES system through the RFP process <br />provided for and established by Ordinance No. 2002-72 for personal service contracts; and <br />WHEREAS, it is the desire of this Council, based upon the recommendations of the <br />Building Commissioner, to authorize the Mayor to enter into a personal services contract with <br />CBS, Inc. to continue to provide ICES maintenance services to the Building Department in the <br />amount of Two Thousand Three Hundred Eighty-Eight ($2,388.00) Dollars; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to dispense with the RFP <br />process required by Ordinance No. 2002-72, and, upon approval of the City's Board of Control, <br />to enter into a contract with Compuhensive Business Solutions, Inc. to provide ICES <br />maintenance services to the City's Building Department, including the IPAC pocket components. <br />Said contract shall be in a form and substance approved by the Director of Law, in substantially <br />the same form as Exhibit A attached hereto. Expenditures made by the City pursuant to said <br />contract shall not exceed Two Thousand Three Hundred Eighty-Eight ($2,388.00) Dollars. <br />, ,s
