<br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2004 - 74 <br />BY: Council Members Nashar and Gareau <br />A RESOLUTION URGING THE GOVERNOR AND THE OHIO <br />GENERAL ASSEMBLY TO RECONSIDER AND AMEND HOi1SE <br />BILL 12, THE NEW STATE CARRYING WEAPONS LAW, SO AS TO <br />AUTHORIZE MUNICIPAL CORPORATIONS TO PROHIBIT STATE <br />LICENSEES FROM CARRYING WEAPONS IN MUNICIPAL PARKS <br />AND UPON PARKING LOTS AND OTHER GROUIVDS AND <br />PREMISES SURROUNDING MUNICIPALLY-OWNED $UILDINGS; <br />FURTHER TO PERMIT MUNICIPAL CORPORATIONS, AS <br />EMPLOYERS, TO PROHIBIT THEIR EMPLOYEES, WHO ARE NOT <br />STATE-CERTIFIED POLICE OFFICERS, FROM CARRYING <br />WEAPONS DURING AND IN THE COURSE OF THEIR <br />EMPLOYMENT AS MUNICIPAL EMPLOYEES, AND DECLARING <br />AN EMERGENCY. <br />WHEREAS, the Ohio General Assembly enacted and Governor Taft has signed <br />into law House Bill 12, effective April 8, 2004, authorizing the issuance of state licenses <br />for individual persons, who are not police officers, to carry concealed weapons, including <br />loaded firearms or handguns in the State of Ohio; and <br />WHEREAS, the City of North Olmsted exercises, by virtue of Article XVIII, <br />Sections 3 and 7 of the Ohio Constitution, and its City Charter, all powers of local self- <br />government, including, but not limited to, owning and operating city parks, and other <br />municipal facilities, many of which include parking lots and other surrounding grounds, <br />and, as a municipal employer, determining the terms and conditions of employment for <br />its municipal employees; and <br />WHEREAS, HB 12, on its face, appears to permit state licensees to carry <br />weapons at city parks, and in parking lots and upon other premises and grounds <br />surrounding municipally-owned buildings, which causes a substantial risk to the health, <br />safety and welfare of the residents of the City of North Olmsted, as well as to City Hall <br />employees; and <br />WHEREAS, HB 12, on its face, further appeaxs to prohibit municipal <br />corporations, as employers, from banning their municipal employees, who are not state- <br />certified police officers, from carrying weapons during and in the course of their <br />employment as municipal employees; and <br />..,
