Resolution No. 2004-74 <br />WHEREAS, these limitations on the powers of municipal corporations stand in <br />stark contrast with the rights of private property owners and private sector employers to, <br />respectively, ban the carrying of weapons on the grounds and premises of their private <br />real property and ban their employees from carrying weapons in the course of their <br />employment as private sector employees; and <br />WHEREAS, it is the desire of this Council to register its opposition in the <br />strongest possible terms to the State of Ohio for permitting its licensees to carry <br />concealed weapons at municipal parks, and upon parking lots and other grounds and <br />premises surrounding buildings owned by municipal corporations, and further permitting <br />its licensees, other than state-certified police officers, to carry weapons during and in the <br />course of their employment as municipal employees; and <br />WHEREAS, the City of North Olmsted respectfully requests the Governor, the <br />Attorney General and the Ohio General Assembly to reconsider the implications of <br />permitting State licensees ta carry weapons law at municipal parks, and upon parking lots <br />and other grounds surrounding buildings owned and operated by municipal corporations, <br />and further to carry weapons during and in the course of their employment as municipal <br />employees, and, upon such reconsideration, to enact appropriate amendments to HB 12, <br />including but not limited to Revised Code Section 2923.12 et seq., in order to authorize <br />and permit municipal corporations to prohibit the carrying of weapons at municipal parks <br />and upon parking lots and other grounds and premises surrounding municipally-owned <br />buildings, and further to authorize and permit municipal corporations to prohibit <br />municipal employees, who are not police officers, from carrying weapons in the course of <br />their employment as municipal employees; <br />NOW, THEREFORE, BE IT RESOL VED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Council of the City of North Olmsted urges the State of <br />Ohio to take appropriate legislative action to amend HB 12, the State Canying Weapons <br />Law, including, but not limited to R.C. Sections 2923.12 et seq., in order to authorize and <br />permit municipal corporations to prohibit State licensees from canying weapons at <br />municipal parks, and upon parking lots and other gounds and premises surrounding <br />buildings owned by municipal corporations, and to further authorize and permit <br />municipal employers to prohibit their municipal employees, who are not state-certified <br />police officers, from carrying weapons during and in the course of their employment as <br />municipal employees. <br />SECTION 2: That the Clerk of Council is hereby directed to forward a fully <br />attested copy of this Resolution, immediately upon its passage and approval, to the <br />following State of Ohio officials: Govemor Bob Taft, Attorney General Jim Petro, State <br />Senator Robert Spada and State Representative Sally Conway Kilbane. <br />
