'• <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2004-86 <br />BY: Mayor Musial <br />A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO AN <br />AGREEMENT WITH SBC FOR THE PURCHASE, INSTALLATION <br />AND MAINTENANCE OF AN UPDATED "911 " POSITRON <br />TELEPHONE SYSTEM FOR THE NORTH OLMSTED POLICE AND <br />FIRE DEPARTMENTS, AND DECLARING AN EMERGENCY, AS <br />AMENDED. <br />WHEREAS, the existing "911" positron telephone system for Police and Fire Department <br />emergency dispatch was not designed with the capacity to receive cellular information, nor is the <br />system still being manufactured or upgraded to current technological standards; and <br />WHEREAS, the Police Department has investigated the specifications and recommends <br />the attached Agreement with SBC in the amount of Forty Eight Thousand Five Hundred Fifty <br />Four ($48,554.00) Dollars. This Agreement includes an additional five (5) year service <br />agreement at a cost of Four Hundred Fifty-Five and 88/100 ($455.88) Dollars per month for a <br />total of Twenty-Seven Thousand Three Hundred Fifty-Two and 80/100 ($27,352.80). <br />WHEREAS, it is not necessary to competitiveiy bid the contract since SBC is the sole <br />source provider of this equipment and local telephone service; "911" emergency access system <br />suppliers are exempt from the requirement for competitive bidding pursuant to Section <br />4931.41(F) of the Ohio Revised Code, and <br />WHEREAS, it is accordingly the desire of this Council to authorize the Mayor to enter <br />into an Agreement with SBC for the purchase and installation of updated "911" positron <br />telephone equipment, software, training and maintenance. <br />NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CIIYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to enter into an agreement <br />with SBC for the purchase of updated 911 equipment, software, training and installation, which <br />agreement shall be in the form and substance of the attached Product Purchase and Maintenance <br />Service Agreement, marked as Exhibit A and attached hereto, with only such changes to be <br />
