.r <br />LEASE AGREEMENT <br />North Olmsted Associates, Ltd. <br />5311 Northfield Road <br />Bedford Heights, Oh 44146 <br />THIS INDENTURE of lease executed in duplicate this 21st day of November , 20 03 , by <br />and between North Olmsted Associates, Ltd., with its principal office located at 5311 Northfield <br />Road, Bedford Heights, Ohio 44146, hereinafter called "Landlord" and James Dubelko or Assignee, <br />a(n), Lunited Liability_, of 26777 Lorain Rd., #416 North Olmsted, OH 44070 , <br />(soleproprzetar, partner.rhip, State aflnc.) (Adrlrerr, City, State, Zp) <br />hereinafter called "Tenant", hereby mutually covenant and agree as follows: <br />Location: <br />1. The Landlord for and in consideration of the rents agreed to be paid by the Tenant as <br />specified hereafter, and the covenants of Tenant contained in this lease, does hereby demise and <br />lease unto Tenant that portion of the premises hereinafter designated the "Builduig" and commonlN? <br />referred to as "The Community Building" situated, lying and being in the City- of North Olmsted, <br />Ohio, the street address being 26777 Lorain Road, said portion, hereinafter designated the <br />"Demised Premises" or the "Premises". <br />Amount of Space: <br />2. The demised premises shall cover an area of approxunately 900 sq. ft. on the Fourth floor <br />(Suite 416 ) in the aforesaid building. Tenant's interests under this indenture are subject to the <br />concurrent and equal rights of other tenants in the building and pxemises of which the demised are a <br />part; such rights including but without limitation to common use of elevator, lobby, corridors, halls, <br />places of ingress and egress, unassigned paYking areas and roadways. <br />Term: <br />3. TO HAVF AND TO HOLD the above described, demised and leased premises for a term <br />of Two (2) year(s), commencing on Februarv 1, 2004, and expiring at 12:01 A.M. on the <br />Second anniversary of said date. <br />Rental: <br />4. The Tenant shall and hereby agrees to pay to Landlord for the demised premises of the said <br />term an annual rental of Twelve Thousand Two HundYed Four and 00/100 Dollars ($12,204.00) <br />payable in equal monthly installments of One Thousand Seventeen and 00/100 Dollars <br />($1,017.00) in advance on the first day of each and every calendar month during said term, at the <br />office of Landlord at the above address or any othex such place as Landlord may designate from <br />time to time in wYiring. A 5% per month late fee will be due on all payments received afteY the fifth <br />day of the month. . Landlord currently holds $1,017.00 to be used as a securiry deposit for <br />faithful performance of this lease by Tenant: said deposit shall be returned at the termination of this <br />I.ease. <br />Check Aeceptance Poliey: By paying for your purchase with your check, you are accepting our <br />check acceptance policy. In the unlikely event your check is retuxned unpaid, you understand and <br />agree that your check may be electronically redeposited or if necessary, redeposited by paper draft. <br />You understand and agree that we may collect a returned check processing charge of $30.00 by the <br />same means and allowable by state law. If you have any questions regarding our check acceptance <br />policv, please call 800-673-3376, our data processing center will be happy to answer your questions. <br />It is agreed that by occupying said premises as a lessee, Tenant formally accepts said premises and <br />acknowledges that they axe in the condition called foY hereunder and that any occupancy by Tenant <br />prior to the effective date hereof shall in all respects, except payment of rental, be that of 'I'enant <br />under this lease.
