CITY OF NORTH 4LMSTED <br />RESOLUTION NO. 2002 - 209 <br />BY: Mayor Musial <br />A RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC <br />SERVICE TO MAgE AN EMERGENCY PURCHASE OF A NEW <br />GENERATOR FOR THE LEBERN LIFT STATION, AND TO <br />AUTHORIZE THE MAYOR, IF NECESSARY, TO ENTER INTO <br />A CONTRACT FOR SAID EMERGENCY PURCHASE, ALL <br />WITHOUT COMPETITIVE BIDDJNG, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the D?irector of Public Service, acting upon the recommendatian of <br />the City Engineer, has advised this Council that an emergency condition exists at the <br />LeBern Lift Station requiring the immediately replacement of the generator at the said Lift <br />Station; and <br />WHEREAS, according to the said Director, until the generator is replaced, the <br />emergency condition will continue to exist at the LeBern Lift Station posing an immediate <br />threat of danger to the health and safety of the residents of North Olmsted; and <br />WHEREAS, this Council expressly finds that an emergency condition exists at the <br />LeBern Lift Station requiring the immediate replacement of the generator at the Lift <br />Station; and <br />WHEREA.S, in light of the emergency condition specifically found to exist, the <br />City is legally not required to competitively bid the purchase of the new generator which <br />will have a cost in excess of the amount for which competitive bidding is otherwise <br />required under the Charter; and <br />WHEREAS, sufficient funds have been appropriated in the Sewer Revenue Fund <br />for this expenditure; and <br />WHEREAS, it is the desire of this Council to authorize the Director of Public <br />Service, following approval of the Board of Control, to immediately purchase a new <br />generator for the LeBern Lift Station from Buckeye Power Sales, Inc., in an amount not <br />to exceed $27,771.00, and to authorize the Mayor, if necessary, to enter into a contract <br />for said purchase and expenditure; and <br />NOW, THEREFORE, BE IT RESOLYED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO.
