CITY OF NORTH OLMSTED ORDINANCE NO. 2002 - 207 BY: MAYOR MUSIAL AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF NORTH OLMSTED TO ENTER INTO A CONTRACT RENEWING THE AGREEMENT BETWEEN THE CITY AND KARRIE SKALL TIPTON FOR THE PROVISION OF GYMNASTICS INSTRUCTION AT THE NORTH OLMSTED RECREATI9N CENTER AND DECLARING AN EMERGENCY. WHEREAS, the City and Karrie Skall Tipton are parties to a contract, wherein Tipton provides gymnastics program services at the Ciiy's Recreation Center; and WHEREAS, Tipton proposes, in conjunction with the gymnastics programs, to fund the acquisition of gymnastics equipment, as needed, and to purchase the City's interest in certain property over the course of the contract term; and WHERF9S, it is the recomtnendation of the Director of Public Safety that the contract between the City and Tipton be renewed and amended to address the obligations of the parties, the gymnastic seivices to be rendered and the disposition of gymnastics equipment; and WHEREAS, it is the desire of this Council approve and authorize the Contract, in substantialty the form as attached hereta, and to apply it retroactively to the date of August 31, 2002, upon the conclusion of the previous ageement and to authorize the Mayor to enter into the said Contract; and NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CDUNTY OF Ci7YAHOGA AND STATE OF OHIO: SECTION 1: That the Mayor be and he hereby is authorized to enter into a Contract with Karrie Skall Tipton in substantiaUy the form and substance as evidenced in the Contract Authorization far the Provision of Gymnastic Equipment, Instructions arcd Related Services to the City of North Olmsted, attached to this Ordinance as "Exhibit A." Said contract shall be effective retroactively to August 31, 2002. SECTION 3: That this Council finds that sufficient funds have been appropriated and set aside to pay all monies that may become due under the said contract. SECTtON 3: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and for the further reason that it is necessary that this ordinance immediately go into effect upon adoption because of the retroactivity of the contract, and further provided it receives the affirn?ative vote of two-thirds of a11 members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor. , ?
