<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2002 - 207 <br />BY: MAYOR MUSIAL <br />AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF NORTH OLMSTED TO <br />ENTER INTO A CONTRACT RENEWING THE AGREEMENT BETWEEN THE CITY AND <br />KARRIE SKALL TIPTON FOR THE PROVISION OF GYMNASTICS INSTRUCTION AT THE <br />NORTH OLMSTED RECREATI9N CENTER AND DECLARING AN EMERGENCY. <br />WHEREAS, the City and Karrie Skall Tipton are parties to a contract, wherein Tipton provides gymnastics <br />program services at the Ciiy's Recreation Center; and <br />WHEREAS, Tipton proposes, in conjunction with the gymnastics programs, to fund the acquisition of <br />gymnastics equipment, as needed, and to purchase the City's interest in certain property over the course of the <br />contract term; and <br />WHERF9S, it is the recomtnendation of the Director of Public Safety that the contract between the City <br />and Tipton be renewed and amended to address the obligations of the parties, the gymnastic seivices to be rendered <br />and the disposition of gymnastics equipment; and <br />WHEREAS, it is the desire of this Council approve and authorize the Contract, in substantialty the form as <br />attached hereta, and to apply it retroactively to the date of August 31, 2002, upon the conclusion of the previous <br />ageement and to authorize the Mayor to enter into the said Contract; and <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, <br />CDUNTY OF Ci7YAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to enter into a Contract with Karrie Skall <br />Tipton in substantiaUy the form and substance as evidenced in the Contract Authorization far the Provision of <br />Gymnastic Equipment, Instructions arcd Related Services to the City of North Olmsted, attached to this Ordinance as <br />"Exhibit A." Said contract shall be effective retroactively to August 31, 2002. <br />SECTION 3: That this Council finds that sufficient funds have been appropriated and set aside to pay all <br />monies that may become due under the said contract. <br />SECTtON 3: That this Ordinance is hereby declared to be an emergency measure immediately necessary <br />for the preservation of the public health, safety and welfare, and for the further reason that it is necessary that this <br />ordinance immediately go into effect upon adoption because of the retroactivity of the contract, and further provided <br />it receives the affirn?ative vote of two-thirds of a11 members of Council, it shall take effect and be in force <br />immediately upon its passage and approval by the Mayor. <br />, <br />? <br />PASSED: 1`.
