THLS AGREEMENT is made day of , 200at the City of North Olmsted, Cowrty of Cuyahoga, State of Ohio, betwcen the City of North Olmsted, a municipal corporation ("the City'), and Kazrie Skall Tipton, 24213 Maria Lane, North Olmsted, Ohio, ("Instructor"). WHERF.fLS, the Instructor has provided both gymnastics and adult exercise instruction for the City at the North Olmsted Recreation Complex pursuarrt to various contracts since September 1, 1999, including a mpdified contract during 2001-2002 which limited services to gymnastics; and WHEREA.S', the parties desire to modify the corrtract so that, effective August 31, 2002 and henceforth thereafter, it shall be the parties irrtention that the Instructor commence an incremental program to aGquire a fult ownerstup interest in most all of the gymnastics equipment and henceforth acquire, at her own expense, additional gymnastics equipment reasonably necessary for the instructional progams; NOW, THEREFORE, the parties have agreed, on the date first written, to the following terms, covenants, and conditions set forth below, acknowledging tha.t sufficient considerarion eDists for said modifications: Section I Nature of and Place of Services Instructor sltall administer a program of gymnastics instruction for the City, and sha11 perform such other duties as are customazily performed by one halding such position in other similar businesses or eirterprises as that engaged in by the City, and sha.lt alsa additionally render such other and unrelated services and duties as may be assigned to Instructor from time to time by the City. Section II Manner of Performance of Services Instructor agrees to peiform, at a11 times faithfully, industriously, and to the best of her ability, experience, and talent, all of the duties tha.t may be required of and from her pursuant to the express and implicit terms of this agreernent, to the reasonable satisfaction of the City. Such duties shall be rendered at North Olmsted Recreation Complex? and at such other place or places as reasonably necessary for gymnastic instruction, so long as the participazrts ane transported to such offsite locations by and have the peimission of parents andlor guardians to participate and that the gyrnnastics competition, facility and equipment is sanctioned by the Amateur Athletic Union/ United States Association of Gymnastics (AAU/USAG) The Instructor further agrces, as a condition precedent of this Agreement, to consent to and submit to the Director of Public Safety, a criminal convictions background check on herself and all employees of said Instructor, so employed for the purpose of or expected to perform the corttractual
