The City reserves the right to cancel and render this Agreement void, ab initia, if in the judgment and the sole discretion of the Director of Public Safety, the inspection of criminal records is either not satisfied or the Instructor's history is deemed unacceptable. Contractor hereby acknowledges that the failure of this condition precedent, for any reasons cited hereina.bove, shall render the Agreemerrt void, without recourse or claim by the Instructor. Such responsibiZities of Instructor shall include, but are not limited to: Operate classes only during hours approved by the Recreation Complex management. 2. Assume all responsibilities of programming subject to obtaining approval for all programs from the City's Recreation Commission prior to the public release of any information on programs. Provide information necessary to register, organize, and advertise classes and programs conducted or supervised by Instnzctor. Such informatian will include class length, time, cost, and other details as necessary or as demanded by the City. 4. Provide proper supervision and qualified instructors for all programs conducted by Instructor. Atl Instructors sha11 be certified via safety training in accordance with the USAG manual and thereby clearly demonstrate knowledge of safety precautions for gymnastics instruction. Hire, fire, pay, supervise, and schedule a11 instiuctors. 6. Refuse to allow pazticipation in classes, lessons, or activities by unregistered or improperly registered persons. 7. A11ow designated Recreation Department programs and classes to use the Gymnastics room and springboard floor located therein, but not the gymnastics equipment of Instnxctor, provided proper supervision is maurtained, such as programs operated by the North Olmsted H'igh School, North Olmsted Kazate, and other programs operated or approved by the City, provided however, that such activities do not conflict with the schedule of existing, established or scheduled gymnastic programs, which may vary or expand from time to time. 8. Instructor sha11 be responsible for maintaining the inventory of all gymnastics equipmerrt, as identified in Schedule A, except as herein provided, as located on the second floor gym area, and Instructor shall reasonably determine, from time to time, whether new equipment is needed in order to maintain the facility as a state of the art facility. Instructor shall notify the City of any new equipment pwchases and shall also notify the City if any equipment listed on Schedule A is removed from service ancUor is replaced . Instructor shall be responsible for supplying all such necessary equipment, the purchasing thereof, and paying for said equipment in full.
