All such <br />improvemerrts or alterations are fixtures, and sha11 remain property of the City. <br />10. Insure that atll areas of the gym and the equipment are inspected and certified in writing <br />on an annual basis by qualified personnel and immediately provide written notification <br />of saia inspection results to the City. The Instructor sha.ll take irnmediate remedial <br />action and report to the City. <br />11. Obtain and mairnain general sports liability insurance far gymnastic instruction activities <br />with policy limits of one million/two million and which names the City of North <br />Olmsted as "an additional Insared" party and provides the City with notice of <br />cancellation. <br />The City shall: <br />Make the second (2nd) floor gym area available for Instructor's progra.ms during hours <br />approved by The City. The City will be entirely responsible for maintenance of and any <br />improvements to the building and its fac2lity, with the exception of gymnastics <br />equipment owned or acquired by the Instructor, but including the floor exercise <br />equipment, as provided herein. <br />The City and the Instructor sha11 corrtinue to maintain co-ownership of the <br />floor exercise equipmern and the City shall, at the dire+ction of and under the <br />supervision of the Instiuctor, perform necessary maiirtenance on the floor exercise <br />ec}uipment, as needed, but not more than three (3) times per year. The Instructor is <br />required to request such maintenance, in a writing, through the Recreation <br />Commissioner, with copy to the Maintenance Foreman, in advance. The City may <br />select a date to schedule such maintenance, upon evatuation of such dates and times as <br />staffing requirements permit, and in consideration of the activities schedule. The <br />Instxuctor is required to suppiy the appropriate clea,ning and taping materials, which <br />expenses shalt be reimbursed by the City in an amount not exceeding Two Hundred <br />Dollars ($200.00) per scheduled maintenance, not more than Sux Hundreri Dollars <br />($600.00) per year. Any additional or emergency maintenance above and beyond the <br />foregoing sh&11 be performed by the Instructor and the costs shared equally by the <br />parties. <br />2. Assist in advertising programs conducted by Tnstiuctor, inctuding providing space in <br />seasonal brochures published by the City for pubticity of Instructor's progams. The <br />City reserves the right to identify the Instructor as an independent contractor in any and <br />all such promotional materials and shall provide the Instructor with a.n opportunity to <br />review such disclaimer Ianguage. <br />3 <br />
