<br />CITY OF NORTH OLMSTED / <br />RESOLUTION NO. 2002 -199 <br />By: Council Members Kasler and Nashar <br />A RESOLUTION URGING THE MAYOR OF THE CITY OF NOR7'H <br />OLMSTED TO ESTABLISH A MAYOR'S COURT IN THE CITY OF <br />NORTH OLMSTED. <br />WHEREAS, the Safety Committee of Council gathered information on the <br />history of Rocky River Municipal Court, the services provided by the Caurt, and North <br />Olmsted's participation in the Court, including the number of North Olmsted cases, case <br />load and income, use of such income and distribution of funds left at the end of each <br />year; and <br />WHEREAS, the Safety Committee held a number of committee meetings, <br />including a meeting at which were present representatives from the Rocky River <br />Municipal Court and representatives from other communities which have established and <br />operate Mayor's Courts in their communities; and <br />WHEREAS, this last referenced meeting was held for the purpose of educating <br />members of City Council, the City Administration, and all interested guests regarding the <br />functions of the Rocky River Municipal Court and the potential for establishing a <br />Mayor's Court in the City of North Olmsted in order to further the administration of <br />justice on a local level; and <br />WHEREAS, it is the finding of this Council that fines for traffic violations have <br />not been addressed recently and are inadequate as they relate to insuring that traffic laws <br />are obeyed in North Olmsted and that violators are duly and justly addressed for said <br />violations; and <br />WHEREAS, the members of the North Olmsted police department have <br />performed their duties in an exemplary manner, enforcing our traffic laws in North <br />Olmsted; and <br />WHEREAS, all of the funds attributable to fines and costs collected as a result of <br />the issuance of tickets by our safety forces to those who have violated our ordinances are <br />sent to the Municipal Court in the City of Rocky River; and <br />WHEREAS, only a small portion of the total amount of costs and fines are <br />returned to the City of North Olmsted; and <br />WHEREAS, when a deficit occurs at the Rocky River Municipal Court, the City <br />of North Olmsted is held responsible for payment of a pro rata share of the funds required <br />to make up such deficit; and <br />WHEREAS, when an overage occurs at the end of a year from the collection of <br />funds assessed against those who violate the ordinances of communities in the Racky <br />
