1, <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2002 - 193 <br />BY: Mayor Norman Musial <br />AN ORDINANCE AMENDING SECTION 559.07 OF THE GENERAL OFFENSES <br />CODE IN ORDER TO INCREASE THE CHARGE ASSESSED FOR FALSE AILARMS <br />IN COMMERCIAL ESTABLISHMENTS AND DECLARING AN EMERGENCY. <br />WHEREAS, North Olmsted Codified Section 559.07 (a) presently imposes a charge of <br />Twenty-five ($25.00) for false alarms received by the Police Department, and Section 559.07 (b) <br />grants relief from such charge under certain circumstances including, but not limited to, the "first" <br />such false alarm; and <br />WHEREAS, the frequency of false alarms arising from commercial establishments and the <br />administrative costs associated with the City's response have continued to increase since the <br />establishment of the false alarm legislation in 1984, and the cunent charge is nat sufficient to offset <br />the administrative costs of the services provided by City police forces; and <br />WHEREAS, the frequency of false alarms arising from residential establishments has not <br />increased significantly, the number of residential false alarms is relatively sma11 compared to <br />commercial false alarms, a.nd the costs of responding to residential false alarms is significant less than <br />that for commercial false alarms; and <br />WHEREAS, it is the desire of this Council, based on the recommendations of the Mayor, the <br />Director of Public Safety and the Police Chief, to amend the Fa1se Alarms provisions of 559.07(a) <br />to increase the false alarm charge to commercial establishments from twenty-five ($25.00) dollars to <br />fifty ($50.00) dollars; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COIINTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Section 559.07 of the General Offenses Code, entitled "Fa1se Alarms." <br />which presently reads as follows: <br />559.07 FALSE ALARMS. <br />(a) A charge of twenty five dollars ($25.00) sha11 be assessed for each false alarm received <br />through local alarms, the police emergency panel, the central alarm station system, or for each <br />false alarm received on any other alarm service which the City has given permission to be <br />installed. Such fee sha11 be assessed against the holder of the permit for the alarm which was <br />falsely activated. <br />
