? Ordinance No. 2002-193 <br />(b) Notwithstanding the fee to be assessed as set forth above, no charge shall be made for <br />the first false alarm subsequent to the issuance of the pernut nor shall there be any charge for a <br />false alarm to wYuch there is no response by the police, nor when the cause has been proven to be <br />an act of God, nor when the cause has been proven due to the malfunction by testing or repairing <br />of telephonic lines mainta.ined and operated by public utilities under the regulation of the Public <br />Service Commission. <br />(c) Any charge for a false alarm wtuch remains unpaid thirty days after date of invoice <br />sha11 result in cancellation of the pernut. <br />(Ord. 84 17. Passed 4- 17-84.) <br />shall be amended, and, as amended, shall read in its entirety as follows: <br />559.07 FALSE ALARMS. <br />(a) A charge of fifty tweRty €r <br />-ye dollars ($2-550.00) sha11 be assessed far each fatse alarm <br />arising from commcrcial establishments and received through local alarms, the police <br />emergency panel, the central alarm station system, or for each false alarm received on any other <br />alarm service which the City has given permission to be installed. A charge of twenty-five <br />dollars ($25.00) shall be assessed for each such false alarm arising from residential premises <br />and received from such licensed residential system. Such charge €ee shall be assessed against <br />the holder of the permit for the alarm which was falsely activated. <br />(b) Notwithstanding the fee to be assessed as set forth above, no charge sha11 be made for <br />the first false alarm subsequent to the issuance of the permit nor sha11 there be any charge for a <br />false alarm to which there is no response by the police, nor when the cause has been proven to be <br />an act of God, nor when the cause has been proven due to the malfunction by testing or repairing <br />of telephonic lines maintained and operated by public utilities under the regulation of the Public <br />Service Commission. <br />(c) Any charge for a false alarm which remains unpaid thirty days after date of invoice <br />sha11 result in cancellation of the permit. <br />SECTION Z: That the operation of any Ordinance, or part of any Ordinance in conflict or <br />inconsistent with any provision of this Ordinance is, to the extent of any such conflict or <br />inconsistency, repealed. <br />SEC770N 3: That this Ordinance sha11 take effect and be in foree from and after the earliest <br />period allowed by law. <br />SECTION 4: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />additional reason that it is necessary this Ordinance goes into effect immediately so that the increased <br />assessment schedule takes effect immediately prior to the year 2003 in order to protect the public <br />fisc, and further provided it receives the affirmative vote of two-thirds of a11 members of Council, it <br />sha11 take effect and be in force immediately upon its passage and approval by the Mayor. <br />2 <br />- ?M _ .. ?... _,... <br />_ " :e.r g? --rv-.-' •M='an#?u#}?a s .. m,,..ex? .. ,.? .. .
