CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2002-179 <br />BY: MAYOR NORMAN MUSIAL <br />AN ORDINANCE AUTHORIZING THE 1VIAYOR OF THE CITY OF <br />NORTH OLMSTED TO CONVEY A PROPERTY INTEREST OF <br />FEE SIMPLE TO CERTAIN REAL PROPERTY IN THE CITY, <br />KNOWN AS PERMANENT PARCEL NOS. 236-12-004 (PART) AND <br />236-11-017 (PART), TO THE GREATER CLEVELAND REGIONAL <br />TRANSIT AUTHORITY (GCRTA) AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, this Council, pursuant to Ordinance No. 2001- 156, Decla.red the Necessity <br />for and authorized the appropriation of Permanent Parcel Nos. 236-12-004 and 236-11-017 <br />(part), located near Interstate-480 and Relocated State Route 252, for the purpose of constructing <br />a roadway upon the said parcels leading to the GCRTA Park-N-Ride facility; and <br />WHEREAS, GCRTA has entered into an Agreement with the City, which was authorized <br />pursua.nt to Ordinance No. 2002-28, whereby the GCRTA assumed, among other obligations, all <br />of the acquisition costs and any fees associated fees with said roadway and agreed to reimburse <br />the City for said costs; and <br />WHEREAS, pursuant to this Council's Declaration of Necessity and in consideration of <br />the aforesaid Agreement between the City and GCRTA, the Director of Law commenced actions <br />exercising eminent domain to acquire said Parcels and subsequently by Ordinance Nos. 2002- 91 <br />and 2002- 96, this Council authorized the purchase said Parcels of land; and <br />WHEREAS, this Council has, by and through Ordinance No. 2002- 159, authorized and <br />directed the Mayor to convey an interest in said Parcels to the GCRTA, to wit, to enter into and <br />grant a Permanent Roadway Easement Agreement with GCRTA, again binding GCRTA, among <br />other obligations, to reimburse the City for all costs associated with the said roadway properties <br />accessing the GCRTA Park-N-Ride facility; and <br />WHEIZEAS, it is the desire of this Council, in further recognition of GCRTA's interest in <br />the aforesaid Parcels, and in consideration of federal law governing transit funding and the City's <br />interest in reimbursement by the GCRTA., to grant and convey an interest of Fee Simple to the <br />GCRTA of the remaining portions of the aforesaid Parcels, that is the strips of land alongside of <br />and outside the boundaries of the roadway and its appurtenances, which roadway area shall <br />continue to be governed by the Permanent Easement Agreement between the City and GCRTA. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIU: <br />
