SECTION 1: That the City of North Olmsted hereby grants and conveys to the Greater <br />Cleveland Regional Transit Authority (GCRTA) a fee simple interest in certain real property in <br />the City, known as part of Permanent Parcel Numbers 236-12-004 (part) and 236-11-017 (part), <br />in substantially the form and substance as evidenced in the Quit Claim Deed and Legal <br />Description attached to this Ordinance as Exhibit A, and that the Mayor is authorized and <br />directed to execute the said document on behalf of the City. <br />SECTION 2: That the consideration for the conveyance of this Fee shall be the <br />reimbursement by GCRTA to the City of North Olmsted all of the acquisition and administrative <br />costs for the properties, specifically determined to be in the total amount of ($280,768.90), and <br />that such consideration actually be paid at the time of recording of this Quit Claim Deed, in the <br />form atta.ched as Exhibit A, subject however to the understanding that said payment is the same <br />as due from GCRTA to the City pursuant to the Agreement approved in Ordinance No. 2002-28 <br />and further subject to the understanding that said payment constitutes the identical consideration <br />and amount described pursuant to the Ordinance No. 2002-159, wherein the City shall convey a <br />Permanent Easement to GCRTA for the roadway, so that it cannot be construed that the GCRTA <br />is obligated to tender said amount twice, in duplicate, or on two occasions. <br />SECTION 4: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is immediately necessary to authorize said agreement to meet schedules <br />which are critical to the Greater Cleveland Regional Transit Authority with respect to the North <br />Olmsted Park-N-Ride, and further provided it receives the affirmative vote of two-thirds of all <br />members of Council, it shall take effect and be in force immediately upon its passage and <br />approval by the Mayor. <br />PASSED: ? - , aD <br />First Reading: D <br />Second Reading: ?? <br />Third Reading: <br />Committee: <br />AT T.- <br />i ' $ARBARA L.
