Labor Standards Act. <br />4. The City and Bak further agree, for purposes of Bak's retirement, that Bak had, as <br />r" <br />of June 20, 2002, twelve weeks accumulated vacation leave and, in addition, had:t.?ee weeks of <br />current vacation leave, any portion of which Bak may take, is entitled to take, and may have <br />already properly taken during his administrative leave prior to retirement, and the balance <br />remaining thereof shall then be paid to Bak in accordance with the City's ordinances and the <br />collective bargaining agreement between the City and Local 1267 of IAFF ["Local 1267 <br />Agreement"], at the time of his retirement. Further, while on his administrative leave prior to <br />retirement, Bak shall be entitled to be paid for any holidays that occur in accordance with the <br />Local 1267 Agreement. A,%P ??- <br />5. The City and Bak further agree, for purposes of Bak's retirement, that Bak has <br />approximately 5,000 hours of sick leave accrued, portions oEwhich rnay be taken by Bak during <br />his administrative leave and prior to retirement, only in accordance with the provisions of <br />Paragraph 2 above. The City agrees, in accordance with the Local 1267 Agreement, that Bak <br />shall be entitled to receive an additional twenty hours (20) huurs of pay for using no sick leave <br />during the six month period preceding the date of execution of this Agreement. The City and Bak <br />further agree that Bak shall be paid for 1000 hours of said accrued sick leave at the time of his <br />retirement, in accordance with the City's benefit ordinance for non-bargaining unit employees. <br />6. Bak may propose, subject to the approval of the City, which approval shall not <br />be unreasonably withheld, a public statement concerning his retirement. The City and Bak agree <br />that no public disparaging and/or derogatory statements will be made by either concerning Bak's <br />3 <br />
