<br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2002 - 165 <br />BY.• Mayor Musial <br />A RESOL UTION AUTHORIZING THE MAYOR AND <br />DIRECTOR OF FINANCE TO COMPENSATE LISA <br />THOMAS, FORMER DIRECTOR OF PUBLIC SAFETY, FOR <br />99.5 HOURS OF ACCUMULATED AND UNI/SED <br />COMPENSATORY TIME, ONA MORAL GLAIMBASIS, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, Lisa Thomas served as Director of Public Safety for the City of North <br />Olmsted during the period February through September, 2002; and <br />3 <br />WHEREAS, the Mayor, prior to appointing Lisa Thornas to be Director of Public Safety, <br />advised her that she would be permitted compensatory time off for hours worked in excess of <br />forty hours per work; and <br />WHEREAS, during the period of her term of office with the City of North Olmsted as <br />Director of Public Safety, Lisa Thomas accumulated 99.5 hours of such compensatory time off <br />which she was unable to take prior to her termination as Director of Public Safety; and <br />WHEREAS, as Director of Public Safety, Lisa Thomas performed her duties with <br />diligence and competence, thereby conferring a public benefit upon the citizens of the North <br />Olmsted community; and <br />WHEREAS, because Lisa Thomas was not an hourly employee, the City is not legally <br />required to compensate her for her hours of accumulated "comp time" while serving as Director <br />of Public Safety; and <br />N'HEREAS, it is the recommendation of the Mayor that, in light of the extraordinary <br />number of hours worked by Lisa Thomas while serving as Director of Public Safety, and her <br />diligence and competency in performing her duties, and her inability to use her comp time prior to <br />the time of her depa.rture from office, this Council recognize a moral claim on the part of the City <br />to compensate Lisa Thomas for all of her accumulated hours of comp time; and <br />WHEREAS, this Council recognizes and concurs that former Director of Public Safety <br />should be compensated for the extraordinary number of hours she worked as Director of Public <br />Safety, which conferred a benefit upon the North Olmsted community, and accordingly recognizes <br />Lisa Thomas' moral claim for compensation for her accumulated and unused comp time; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />?? .,...r < .. . ?, . .
