CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2002-159 <br />BY: MAYOR MUSIAL <br />AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF <br />NORTH OLMSTED TO ENTER INTO, GRA?NT, AND RECORD A <br />PERMANENT ROADWAY EASEMENT AGREEMENT WITH THE <br />GREATER CLEVELAND REGIONAL TRANSIT AUTHORITY <br />(GCRTA), PROVIDING FOR GCRTA TO BE SOLEY LIABLE FOR <br />AND PAY ALL COSTS ASSOCIATED WITH THE ACQUISITION, <br />CONSTRUCTION, MAINTENANCE AND REPAIR OF CERTAIN <br />REAL PROPERTY IN THE CITY, KNOWN AS PERMANENT <br />PARCEL NOS. 236-12-004 AND 236-11-017 (PART), AS DESCRIBED <br />AS A ROADWAY TO THE GCRTA PARK-N-RIDE FACILITY, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, this Council, pursuant to Ordinance No. 2001- 156, Declared the Necessity <br />for and authorized the appropriation of Permanent Parcel Nos. 236-12-004 and 236-11-017 <br />(part), located nea.r Interstate-480 and Relocated State Route 252, for the purpose of constructing <br />a roadway upon the said parcels leading to the GCRTA Park=N-Ride facility; and <br />WHEREAS, GCRTA has entered into an Agreement with the City, which was authorized <br />pursuant to Ordinance No. 2002-28, whereby the GCRTA remain assumed all of the acquisition, <br />construction, maintenance, and repair costs associated with the said roadway and the Park-N- <br />Ride facility, and to further documented its obligation to indemnify and hold harmless the City of <br />North Olmsted from any and all claims for liability for injury or damage which might in the <br />future arise from the acquisition, construction, maintenance and/or repair and use of said <br />roadway and parking facility; and <br />WHEREAS, pursuant to this Council's Declaration of Necessity and in consideration of <br />the aforesaid Agreement between the City and GCRTA, the Director of Law commenced actions <br />exercising emminent domain to acquire said Parcels and subsequently by Ordinance Nos. 2002- <br />91 and 2002- 96, this Council authorized the purchase said Parcels of land for the roadway to and <br />parking facilities of the NONIBL Park-N-Ride; and <br />WHEREAS, it is the desire of this Council to convey an interest in said Parcels to the <br />GCRTA and accordingly authorize the Mayor to enter into and grant a Permanent Roadway <br />Easement Agreement with GCRTA, again binding GCRTA to pay all costs associated with the <br />acquisition, construction, maintenance, and repair of the said roadway leading to the GCRTA <br />
