<br />Park-N-Ride facility, as well as again documenting GCRTA's obligation to indemnify the City <br />from and all claims that may a.rise from the operation thereof; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the City of North Olmsted hereby grants a Permanent Roadway <br />Agreement to the Greater Cleveland Regional Transit Authority (GCRTA) for the use of <br />Permanent Parcel Numbers 236-12-004 and 236-11-017 (pazt), for the construcrion, repair and <br />maintenance of a roadway to the GCRTA/NOMBL Park-N-Ride facility, in substantially the <br />form and substance as evidenced in the Permanent Roadway Easement Agreement attached to <br />this Ordinance as Exhibit A, and that the Mayor is authorized to execute the said document on <br />behalf of the City. <br />SECTION Z: That, by authorizing the Mayor to enter into this Permanent Roadway <br />Easement Agreement, this Council is in no way limiting its power and discretion to determine, at <br />a subsequent date, whether the City of North Olmsted should accept for dedication the said <br />roadway leading to the Park-N-Ride facility located in the City of North Olmsted and the act of <br />granting said Permanent Roadway Easement shall not constitute dedication thereof. <br />SECTION 3: That the consideration for this perpetual easement shall be reimbursement <br />by GCRTA to the City of North Olmsted all of the acquisition and administrative costs, as set <br />forth in the Agreement approved in Ordinance No. 2002-28, specifically determined to be in the <br />total amount of ($280,768.90), actually paid prior to the recording of this easement, together with <br />the ongoing costs associated with the liability, maintenance and repair of the roadway, in <br />perpetuity, as fully outlined in the Agreement with GCRTA which was adopted in Ordinance No. <br />2002-28 and as said Ageement is hereby incorporated into this Permanent Roadway Agreement. <br />SECTION 4: That the further consideration for this perpetual easement shall be the <br />obligation of GCRTA to maintain and comply with any and all laws administered by and <br />regulations promulgated by the Ohio Department of Transportation (ODOT) for and in relation <br />to the issuance of Permit No. 089CR02, in the name of the City of North Olmsted, for the use <br />and benefit of GCRTA/NOMBL Park N Ride facility, specifically the limited access curb cut at <br />Crreat Northern Blvd. (Rt. 252), which prohibits any other use or access. <br />SECTION 5: That the said roadway accessing said Park-N-Ride facility shall be known <br />as "NOMBL Lane" regardless of the status of and notwithstanding the absence of formal <br />dedication of the street to the City and the Service Director is hereby authorized and directed to <br />install appropriate signage so identifying said roadway, regardless of the status or and <br />notwithstanding the absence of such street upon the off'icial City street map. <br />SECTION 6: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />2 <br />
