BASE PAY DIFFEItEA1'IAL, AND HEALfiff eAR I E IN,SURAIVCE <br />BENEFITS, FROM ONE (1) YEAR TO A 1lMMAI"?f' OF FIVL (S) YEARS, AND <br />DECLARING AN EMERGENCY, AS AMENDED. <br />WHEREAS, this Council, on December 18, 2001, adopted Ordinance No. 2001-146, which <br />created new Section 161.08 of the Administrative Code, errtitled "Military Leave Benefits, providing <br />that permanent city employees who are called to active milita.ry duty pursuant to an executive order <br />issued by the President af the United States or an act of Congress sha11 suffer no loss of pay or <br />benefits for the period or periods of time they aze called to active duty pursuant to such order or act, <br />which such period or periods shall not exceed a total of one year of active duty time; and <br />WHEREAS, it is the desire of this Council to amend said Section 161.08 of the <br />Administrative Code so as to extend the time period during which permanent city employees are <br />entitled to receive seeh base pay differential asYd health care benefits from one (1) year to five (5) <br />years; and _ _ _ <br />WHEREAS, it is the intent af this City, exercising its home-rule powers of local self- <br />government, to provide the military leave benefits set forth in this Ordinance to its permanent city <br />employees in lieu of the benefits which axe provided for municipal employees in Section 5923.05 of <br />the Ohio Revised Code; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Section 161.08 of the Administrative Code, entitled "Military Leave <br />Benefits," which presently reads as follows: <br />"161.08. MILITARY LEAVE BENEFITS. <br />(A)(1) Permanetrt public employees of the City, as defined in Section 5903.01 of the <br />Revised Code, who are members of the Ohio organized militia, or members of other reserve <br />components of the armed forces of the United States, including the Ohio National Guard, are <br />entitled to leave of absence from their respective City positions without loss of pay or benefits for <br />the time they are performing service in the uniformed services because of an executive order <br />
