"Without loss of pay" means that the City sha11 pay to any such emplayee, in accordance, to <br />the extent practicable, with the City's regular payment schedule, the difference between the pay <br />the employee would be receiving as a City employee had he not have been called to active duty, <br />and the pay he is receiving as a member of the Ohio organized militia or other reserve components <br />of the armed forces of the United States, including the Ohio National Guard. "Benefits" means <br />only those benefits that are provided to such employees by ordinance of the City or collective <br />bargaining agreement. <br />(B) Each permanent public employee who is entitled to leave provided under division (A) <br />of this section shall submit to the permanent public employee's appointing authority the published <br />order authorizing the ca11 or order to the uniformed services or a written statement from the <br />appropriate military commander authorizing that service, prior to being credited with such leave." <br />Be amended, and, as amended, shall read in its entirety as follows: <br />"161.08. MILITARY LEAVE BENEFITS. <br />(A)(1) Permanent public employees of the City, as defined in Section 5903.01 of the <br />Revised Code, who are members of the Ohio organized militia, or members of other reserve <br />components of the armed forces of the United States, including the Ohio National Guard, are <br />entitled to leave of absence from their respective City positions without loss of pay or benefits for <br />the time they are performing service in the uniformed services because of an executive order <br />issued by the president of the United States or an act of Congress for a period not to exCeed em <br />fiw one yeazs. "Without loss of pay" means that the City shall pay to any such employee, in <br />accordance, to the extent practicable, with the City's regular payment schedule, the difference <br />between the pay the employee would be receiving as a City employee had he not have been called <br />to active duty, and the pay he is receiving as a member of the Ohio organized militia or other <br />reserve components of the armed forces of the United States, including the Ohio National Guard. <br />"Benefits" means only those benefits that are provided to such employees by ordinance of the <br />City or collective barga.ining agreement. <br />(2) If any such employee subject to an e7cecutive order ar act of Congress as set' forth in <br />divisian (A)(1) above,:is required to p,eiform services in the unifornied services for a period which <br />exceeds one year, then'the einployEe's lsave of abse.nce from his or ler respective City posifiion <br />shatl be extendeci, as necessary, fQr a perioct not ta exeeed an additional faur years.
