<br />employed by said company obtains or maintains a valid certificate and provides direct <br />supervision of all work in lieu of the corporate personnel under sanction. <br />(b) No person, firm, corporation or contractor shall knowingdy subcontract to any <br />second party when that party does not possess a current certification of registration <br />or local license. <br />1317.99 PENALTY. <br />(a) In addition to any other civil or criminad penalties, any person, firm, <br />corporation or contractor who engages in the work or trade of a contractor without <br />frrst acquiring a certifzcate of registration or, where applicable, a local license, or <br />otherwise violates Section 1317.05 and 1317.09, shall be subject to one or more of <br />the following penalties: <br />1. A monetary penalty of twice the annual certification fee and, after Notice <br />to Stop Work is issued, a per diem monetary penalty of the same amount; <br />and <br />2. The Building Commissioner shall order compliance with any and all <br />violations of this Buidding Code charged on the records to the holder of <br />such suspended or revoked certificate or collect from the applicant, as a <br />penalty for violation, the reasonable costs of correcting such violations, <br />together with interest from the date of violation; and <br />3. In addition to penalties upon the subcontractor in violation, any general <br />contractor in violation of Section 1317.09(b) shall be fined twice the <br />annual certication fee for each vrolation and, match the fine levied upon <br />the subcontractor, whether or not said subcontractor pays said fine. <br />(b) In addition to any other civil or criminal penalties, any person whose <br />certificate has been suspended or revoked pursuant to Section 1317.06 shall be <br />subject to the following penalties: <br />1. No building permits may be issued during such suspension or revocation <br />period and, upon application for reinstatement and payment of the fees <br />attendant thereto, a monetary penaliy shall be imposed in an amount <br />equal to twice the annual renewal fees that would otherwise have been <br />paid from the date of the suspension; and <br />2. The Building Commissioner shall order compliance with any and all <br />violations of this Building Code charged on the records to the holder of <br />such suspended or revoked certifrcate or collect from the applicant, as a <br />penalty for violation, the reasonable costs of correcting such violations, <br />together with interest from the date of'violation. <br />(c) Any violation of Section 1317.05 or Section 1317.09 shall constitute a <br />misdemeanor of thefirst degree. <br />(EDITOR'S NOTE: See Section 1301.99 for general Building Code penalty.) <br />
