SECTION 1: That this Council deems it necessary and appropriate, in support of and in cooperation with the GCRTA, in consideration of the City's appropriation of the fee simple title interest in and to the following parcels of real property located in the City of North Olmsted: Permanent Parcel Nos. 236-11-017 and 236-12-004, for the purpose of constructing a public roadway, to file a Permit Application with the ODOT to authorize said roadway entrance to the Park-N-Ride facility. The Council intends by this action that any and all Agreements with the GCRTA regarding the Park-N-Ride facility shall remain in full force and effect and that this administrative application shall not be construed as releasing GCRTA from its obligation, nor be considered a waiver of any of the City's rights thereunder. SECTION 2: That the Mayor of the City of North Olmsted is authorized and directed to cause written application for a permit to be issued by ODOT for the installation of a curb cut, together with all the appurtenances thereto, as previously set forth and planned in detail, located on Route 252 just south of the intersection of Interstate 480 eastbound entrance ramp, specifically upon the form attached hereto and incorporated herein by reference, together with any additional administrative action required of the ODOT to fulfill the permit requirements. SECTION 3: That it is found and determined that all formal actions of this Council concerning and relating to the adoption of this Resolution were taken at meetings of this Council and of its committees, if any, which were open to the public in compliance with law. SECTION 4: That this Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and for the additional reason that this authorization must go into effect immediately so that the administrative proceedings before ODOT shall not be delayed and that construction will continue in a manner and upon a time schedule which will not interfere with or delay the construction of the proposed public roadway and Park-N-Ride facility, and further provided it receives the affirmative vote of two-thirds of a11 members of Council, it shall take effect and be in force immediately upon its passage a7;4-/ y the Mayor.
