<br />SECTION 1: That this Council deems it necessary and appropriate, in support of and in <br />cooperation with the GCRTA, in consideration of the City's appropriation of the fee simple title <br />interest in and to the following parcels of real property located in the City of North Olmsted: <br />Permanent Parcel Nos. 236-11-017 and 236-12-004, for the purpose of constructing a public <br />roadway, to file a Permit Application with the ODOT to authorize said roadway entrance to the <br />Park-N-Ride facility. The Council intends by this action that any and all Agreements with the <br />GCRTA regarding the Park-N-Ride facility shall remain in full force and effect and that this <br />administrative application shall not be construed as releasing GCRTA from its obligation, nor be <br />considered a waiver of any of the City's rights thereunder. <br />SECTION 2: That the Mayor of the City of North Olmsted is authorized and directed to <br />cause written application for a permit to be issued by ODOT for the installation of a curb cut, <br />together with all the appurtenances thereto, as previously set forth and planned in detail, located <br />on Route 252 just south of the intersection of Interstate 480 eastbound entrance ramp, specifically <br />upon the form attached hereto and incorporated herein by reference, together with any additional <br />administrative action required of the ODOT to fulfill the permit requirements. <br />SECTION 3: That it is found and determined that all formal actions of this Council <br />concerning and relating to the adoption of this Resolution were taken at meetings of this Council <br />and of its committees, if any, which were open to the public in compliance with law. <br />SECTION 4: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />additional reason that this authorization must go into effect immediately so that the administrative <br />proceedings before ODOT shall not be delayed and that construction will continue in a manner <br />and upon a time schedule which will not interfere with or delay the construction of the proposed <br />public roadway and Park-N-Ride facility, and further provided it receives the affirmative vote of <br />two-thirds of a11 members of Council, it shall take effect and be in force immediately upon its <br />passage a7;4-/ y the Mayor. <br />PASSED: ' 0 a ?- <br />Afi EST: <br />3ARA L SEMAN ? <br />of Council <br />APPROVED: <br />8 ? oz ?
