<br />Ordinance No. 2002-118 <br />Page 2 <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Sections 1149.02, 1149.03, 1149.041, and 1149.07 of Chapter 1149 <br />of the Zoning Code (Mixed Use District) which presently read as follows: <br />" 1149.02 M[NIMUM REQUIRED AREA. <br />The minimum required development area for Mixed Use District A and Mixed Use District <br />B shall not be less than ten acres. The minimum required developmerrt area for Mixed Use <br />District C sha11 be not less than thirty-five acres. In Mixed Use District D, the minimum <br />required development area sha11 be not less than five acres. <br />1149.03 USES PERNIITTED. <br />(a) Mixed Use District A. Any of the uses defined in subsections (b)(1), (2) and (3) hereof <br />shall be permitted. Additionally, uses permitted in a General Retail Business District, as set <br />forth in Section 1139.01, shall be permitted provided, however, that the plan of the <br />development azea meets all of the requirements and restrictions set forth in this section and <br />Sections 1149.04 to 1149.07 and further provided that the proposed use is approved by <br />the Planning Commission, which shall determine whether it has been integrated into the <br />plan in such a manner as sha11 promote the intent and purposes of a mixed use <br />development. <br />(b) Mixed Use District B. Any of the uses defined in subsections (b)(1), (2) and (3) hereof <br />shall be permitted. Additionally, the following business uses shall be permitted provided, <br />however, that the plan of the development area meets all of the requirements and <br />restrictions set forth in this section and Sections 1149.04 to 1149.07 and further provided <br />that the proposed use is approved by the Commission, which sha11 determine whether it <br />has been integrated into the plan in such a manner as shall promote the intent and purposes <br />of a mixed use development: <br />- Offices-professionaUbusiness; <br />- Hotel; <br />- Banks and other financial institutions; <br />- Restaurant-freestanding full service; <br />- Restaurant/lounge within office building or hotel; <br />- Sale of books, magazines, newspapers, tobacco products, drugs, flowers, gifts and <br />stationary within office building or hotel; <br />- Barber/beauty shop, travel agency within office building or hotel; and <br />- Day care center. <br />(1) Multiple dwellings. There sha11 be permitted only the multiple dwelling uses permitted <br />in a Multiple Residence <br />(Apartment) District subject to the same terms, provisions, conditions and limitations <br />imposed upon such uses by <br />
